.word.word广东聚仁人力资源有限公司(聚仁集团).word第一章总则·············································································································································1第二章劳务外包员工的招募、录用和体检·······································································2第三章订立劳动合同····························································································································3第四章劳务外包员工培训和管理·······································································································3第一节劳务外包员工的培训·······················································································································3第二节劳务外包员工的管理·······················································································································3第三节外派客服专员··································································································································4第五章劳务外包员工福利待遇············································································································4第一节工资发放·········································································································································5第二节社会保险和补充保险·······················································································································6第三节伙食与住宿······································································································································7第四节休息休假·········································································································································8第五节劳动保护·········································································································································8第六章劳务外包员工患病和伤亡处理·······························································································9第一节工伤处理·········································································································································9第二节患病或非因工伤亡的处理················································································································9第七章离职与退回······························································································································10第八章劳动关系转移··························································································································12第九章费用结算···································································································································13第十章违约责任···································································································································14.word第十一章其它约定·······························································································································14第十二章附则·······································································································································15.word劳务外包协议书甲方:地址:签约代表人:业务联系人:邮编:电话:传真:乙方:地址:签约代表人:业务联系人:邮编:电话:手机:第一章总则第一条甲、乙双方依据《中华人民共和国合同法》、《中华人民共和国劳动法》和《中华人民共和国劳动合同法》,以及其它相关法律、法规和双方所在地人民政府的有关规定,经友好协商,就劳务外包事宜订立本协议,以资双方共同遵守。第二条劳务外包是指劳务外包服务机构(乙方)根据用工单位(甲方)的人力资源需求,与劳务外包员工建立劳动关系,将员工劳务外包到甲方工作,向甲方提供劳务的一种专业化的人力资源管理服务活动,也是市场经济体制下的一种合法的新型劳动用工形式。第三条本协议所称的“劳务外包员工”均指乙方根据本协议向甲方劳务外包的员工,该员工的劳动人事关系归属乙方,由乙方与之订立劳动合同。第四条本协议期限为1年,从2017年月日到年月日,协议到期前双方如未书面提出终止合作的,期限自动延续。.word第二章劳务外包员工的招募、录用和体检第五条甲方增补人员前应与乙方协商确定增补方案,增补方案作为本协议附件,与本协议具有同等法律效力。第六条本协议有效期内,乙方在甲方的劳务外包员工人数少于人的,双方应当在三十日内就增补差额人员确定增补方案。第七条甲方应向乙方提供公司简介、招聘要求、营业执照副本等书面文件。第八条乙方按双方确定的增补方案组织符合甲方要求的应聘者,并进行证件查验、初步考核及面试,按时按量推荐合格人选给甲方复试。第九条甲方可协助乙方进行劳务外包员工招募工作,并对应聘者的录取有最终决定权。第十条乙方以用人单位的名义招募劳务外包至甲方的劳务外包员工,同时告知应聘者甲方为实际用工单位。第十一条甲方组织初步录用的应聘者到东莞市的区级及以上医院进行常规体检,合格者方可正式录用,入职体检费由应聘者承担。第十二条甲方要求从事特殊工种的应聘者在正式录用前进行超常规体检的,体检费由甲方承担。特殊工种是指职业活动中存在的各种有害的化学、物理、生物因素以及在作业过程中产生的其他职业有害因素,因接触粉尘、放射性物质和其他有毒、有害物质等因素而较容易引起职业病的工种。体检项目和费用依据东莞市职业病防治中心的规定执行。第十三条甲方应当将工作过程中可能产生的职业病危害及其后果、职业病防护措施和待遇等如实告知乙方和劳务外包员工,不得隐瞒或者欺骗。.word第三章订立劳动合同第十四条劳务外包员工被甲方正式录用一个月内,乙方与之订立劳动合同,并接受甲方的监督和检查。第十五条一般情况下,乙方使用自定的劳动合同与劳务外包员工签约;若甲方要求乙方使用当地劳动部门印制的劳动合同与劳务外包员工签约,或对劳动合同进行鉴证的,乙方在一个月内办理,但相关费用由甲方承担。第十六条甲方应为乙方与劳务外包员工签订劳动合同提供便利,或者在不影响甲方生产工作的情况下协助乙方安排劳务外包员工到指定地点签订劳动合同。第十七条乙方应为劳务外包员工建立人事档案,并及时将劳务外包员工的动态记入档案,甲方有权对乙方建立的人事档案进行监督和检查。第四章劳务外包员工培训和管理第一节劳务外包员工的培训第十八条乙方应对新入职劳务外包员工进行培训,教育劳务外包员工遵守中华人民共和国法律、法规和规章,保守甲方的各项商业秘密,遵守甲方的工作制度、劳动纪律及职业道德。第十九条甲方负责新入职劳务外包员工的岗前操作技能培训、安全管理教育。第二十条甲方有权对参与岗前培训的劳务外包员工进行考核,并可在试用期内将考核不合格者退回乙方,以及要求乙方更换新人选。第二十一条甲方负责对劳务外包员工进行在职培训,使其符合该岗位的技能要求。甲方可要求乙方协助开展在职培训。第二节劳务外包员工的管理.word第二十二条甲方负责对劳务外包员工进行工作现场管理及日常考核管理,考核标准依据甲方的正式制度性文件执行。甲方应当依据符合法律规定的规章制度对劳务外包员工进行管理,若甲方对劳务外包员工进行处罚的依据违法,乙方有权要求甲方改正,若因甲方的不合法处罚引发劳动争议或给乙方造成损失,甲方应当赔偿。第二十三条因甲方管理不当,劳务外包员工在工作现场犯过失的,乙方不承担责任。第二十四条甲方可根据实际生产任务需要安排劳务外包员工的工作时间,但不得违反相关劳动法律规定。第二十五条双方管理人员应定期沟通,交流劳务外包员工的情况,改善工作质量。第二十六条乙方应定期探访劳务外包员工,帮助劳务外包员工解决生活和工作中遇到的困难,稳定劳务外包员工的思想情绪。第二十七条甲方在不影响生产工作的情况下,应协助乙方安排劳务外包员工参与乙方举办的业余文化活动。第二十八条乙方应对离职的劳务外包员工进行离职调查,并定期提交离职分析报告供甲方参考,双方应在此基础上努力减少劳务外包员工的流失率。第三节外派客服专员第二十九条劳务外包员工达到一百五十人时,乙方派出一名外派客服专员常驻甲方,负责处理劳务外包员工的非生产性人
