Issue1241Standard1.2.10STANDARD1.2.10CHARACTERISINGINGREDIENTSANDCOMPONENTSOFFOODPurposeThisStandardsetsoutspecificrequirementsforthedeclarationofthepercentageofcharacterisingingredientsandcomponentsofcertainfoodproductswhicharerequiredtobedeclared.TableofProvisions1Interpretation2Declarationofcharacterisingingredientsandcharacterisingcomponents3Methodofcalculatingtheproportionofcharacterisingingredientsbyingoingweight4Methodofcalculatingtheproportionofcharacterisingingredientswheremoisturelossoccurs4AMethodofdeterminingtheproportionofthecharacterisingingredientwheretheproportionisdeclaredinanutritioninformationpanel5Methodofdeclarationofcharacterisingingredients6Methodofcalculatingtheproportionofcharacterisingcomponents7MethodofdeclarationofcharacterisingcomponentsClauses1Interpretation(1)InthisStandard–characterisingcomponentmeansacomponentofafoodthat–(a)ismentionedinthenameofafood;or(b)isusuallyassociatedwiththenameofafoodbytheconsumer;or(c)isemphasisedonthelabelofafoodinwords,picturesorgraphics.Editorialnote:Twoexamplesofcharacterisingcomponentsoffoodaremilkfatinicecreamandcocoasolidsinchocolate.characterisingingredientmeansaningredientorcategoryofingredientsthat–(a)ismentionedinthenameofafood;or(b)isusuallyassociatedwiththenameofafoodbytheconsumer;or(c)isemphasisedonthelabelofafoodinwords,picturesorgraphics;butdoesnotinclude–(d)aningredientoracategoryofingredientswhichisusedinsmallquantitiesforthepurposesofaflavouring;or(e)aningredientthatisthesoleingredientofafood;or(f)acategoryofingredientsthatcomprisesthewholeofthefood;or(g)aningredientorcategoryofingredientswhich,whilementionedinthenameofthefood,isnotsuchastogovernthechoiceoftheconsumer,becausethevariationinthequantityisnotessentialtocharacterisethefood,ordoesnotdistinguishthefoodfromsimilarfoods.FederalRegisterofLegislativeInstrumentsF2011C00538Issue1242Standard1.2.10(2)CompliancewithlabellingrequirementselsewhereinthisCodedoesnotofitselfconstituteemphasisforthepurposesofparagraph(c)ofthedefinitionofcharacterisingcomponentorcharacterisingingredient.Editorialnote:Standard1.2.4defines‘ingredient’as‘anysubstance,includingafoodadditive,usedinthepreparationmanufactureorhandlingofafood’.Acomponentofafoodthatisnaturallypresentinafoodisnotaningredientofthefoodandthereforecannotbeacharacterisingingredient.Forexample,caffeinethatisnaturallypresentincoffeeorteaisnotaningredientandthereforecannotbeacharacterisingingredient.Examplesofingredientsthatarementionedinthenameofthefoodinclude‘strawberryyoghurt’,and‘steakandkidneypie’.Anexampleofacategoryofingredientsmentionedinthenameofthefoodis‘vegetables’ina‘vegetablepastie’and‘meat’ina‘meatpie’.Indecidingwhichingredientsare‘usuallyassociatedwiththenameofafoodbyaconsumer’,forexample,‘chilliconcarne’,considerationshouldbegiventowhatanappropriatedescriptivenamefortheproductmightbe,werethistobegiven.Someexamplesare-‘Chilliconcarne’couldbedescribedas‘chilliflavouredmincedbeefwithkidneybeans’.Giventhisdescription,theproportionof‘mincedbeef’and‘kidneybeans’shouldbedeclared.Theproportionof‘chilli’wouldnotberequiredtobedeclaredasitisaddedforthepurposesofaflavouringandwouldbeexemptunderparagraph(d)ofthedefinition.A‘springroll’couldbedescribedas‘vegetablesinalightpastry’.Theproportionof‘vegetables’inthespringrollwouldinthiscasebedeclared.Examplesofingredientsthatareemphasisedonthelabelofafoodinwords,picturesorgraphicswouldincludeanillustrationof‘fruitandnuts’infruitandnutchocolate,or‘cheese’ifitisemphasisedbywordsonthelabelsuchas‘extracheese’.2Declarationofcharacterisingingredientsandcharacterisingcomponents(1)Subjecttosubclause(2),subclause(3)andsubclause(4),thelabelonapackageoffoodmustincludeadeclarationoftheproportionofcharacterisingingredientsandcharacterisingcomponentsofthefood,calculatedandexpressedinaccordancewiththisStandard.(2)WheretheproportionofacharacterisingcomponentofafoodisdeclaredinaccordancewiththisStandard,theproportionofingredientsorcategoryofingredientscontainingthatcharacterisingcomponentisnotrequiredtobedeclared.Editorialnote:Forexample,wheretheproportionof‘cocoasolids’inchocolateisdeclared,itisnotnecessarytodeclaretheproportionoftheingredientsthatcomprisethe‘cocoasolids’.(3)Adeclarationofthepercentageofthecharacterisingingredientsandcharacterisingcomponentsofafood,calculatedandexpressedinaccordancewiththisStandard,wherethe–(a)foodisunpackaged;or(b)foodismadeandpackagedonthepremisesfromwhichitissold;mustbe–(c)displayedonorinconnectionwiththedisplayofthefood;or(d)providedtothepurchaseruponrequest.FederalRegisterofLegislativeInstrumentsF2011C00538Issue1243Standard1.2.10(4)Subclause(1)andsubclause(3)donotapplyto–(a)foodpackagedinthepresenceofthepurchaser;or(b)foodsforcateringpurposes;or(c)fooddeliveredpackagedandreadyforimmediateconsumptionattheexpressorderofthepurchaser;or(d)preparedfilledrolls,sandwiches,bagelsandsimilarproducts;or(e)foodsoldatafundraisingevent;or(f)foodinasmallpackage;or(g)foodstandardisedinStandard2.9.1;or(h)curedand/ordriedmeatfleshinwholecutsorpieces;or(i)alcoholicbeveragesstandardis
