TheNRCissuesregulatoryguidestodescribeandmakeavailabletothepublicmethodsthattheNRCstaffconsidersacceptableforuseinimplementingspecificpartsoftheagency=sregulations,techniquesthatthestaffusesinevaluatingspecificproblemsorpostulatedaccidents,anddatathatthestaffneedsinreviewingapplicationsforpermitsandlicenses.Regulatoryguidesarenotsubstitutesforregulations,andcompliancewiththemisnotrequired.MethodsandsolutionsthatdifferfromthosesetforthinregulatoryguideswillbedeemedacceptableiftheyprovideabasisforthefindingsrequiredfortheissuanceorcontinuanceofapermitorlicensebytheCommission.Thisguidewasissuedafterconsiderationofcommentsreceivedfromthepublic.Regulatoryguidesareissuedin10broaddivisionsC1,PowerReactors;2,ResearchandTestReactors;3,FuelsandMaterialsFacilities;4,EnvironmentalandSiting;5,MaterialsandPlantProtection;6,Products;7,Transportation;8,OccupationalHealth;9,AntitrustandFinancialReview;and10,General.ElectroniccopiesofthisguideandotherrecentlyissuedguidesareavailablethroughtheNRC=spublicWebsiteundertheRegulatoryGuidesdocumentcollectionoftheNRC=sElectronicReadingRoomat=sAgencywideDocumentsAccessandManagementSystem(ADAMS)at(DraftwasissuedasDG-1204,datedMarch2009)GUIDANCEFORITAACCLOSUREUNDER10CFRPART52A.INTRODUCTIONThisguidedescribesamethodthatthestaffoftheU.S.NuclearRegulatoryCommission(NRC)considersacceptableforuseinsatisfyingtherequirementsfordocumentingthecompletionofinspections,tests,analyses,andacceptancecriteria(ITAAC).Inparticular,thisguideendorsesthemethodologiesdescribedintheindustryguidancedocumentNuclearEnergyInstitute(NEI)08-01,“IndustryGuidelinefortheITAACClosureProcessUnder10CFRPart52,”Revision3,issuedJanuary2009(Ref.1),fortheimplementationofTitle10,Section52.99,“Inspectionduringconstruction,”oftheCodeofFederalRegulations(10CFR52.99)(Ref.2).TheNRCissuesregulatoryguidestodescribetothepublicmethodsthatthestaffconsidersacceptableforuseinimplementingspecificpartsoftheagency’sregulations,toexplaintechniquesthatthestaffusesinevaluatingspecificproblemsorpostulatedaccidents,andtoprovideguidancetoapplicants.Regulatoryguidesarenotsubstitutesforregulationsandcompliancewiththemisnotrequired.Thisregulatoryguidecontainsinformationcollectionrequirementscoveredby10CFRPart52thattheOfficeofManagementandBudget(OMB)approvedunderOMBcontrolnumber3150-0151.TheNRCmayneitherconductnorsponsor,andapersonisnotrequiredtorespondto,aninformationcollectionrequestorrequirementunlesstherequestingdocumentdisplaysacurrentlyvalidOMBcontrolnumber.RG1.215,Page2B.DISCUSSIONBackground10CFR52.99includesrequirementsfordocumentingandreportingthesatisfactionoftheacceptancecriteriaforeachITAACinthecombinedlicense(COL).ThisguideprovidesguidanceonlicenseenotificationstotheNRCforcompletedanduncompletedITAAC.TheNRCusesthesenotificationstodeterminewhetherITAAChavebeensuccessfullycompleted,tofacilitatepublicparticipationintheITAAChearingprocess,andforinspectionplanning.ThisregulatoryguidedescribesmethodsthattheNRCstaffconsidersacceptableforlicenseestousefordocumentingandreportingthesatisfactorycompletionoftheacceptancecriteriaforeachITAACintheCOL.Thisregulatoryguide,throughitsendorsementofanindustryguidancedocumentforlicensees,providesguidanceoncomplyingwiththerequirementsof10CFR52.99.1.DevelopmentofIndustryGuidelineDocumentNEI08-01Inaccordancewith10CFR52.97(b),COLsmustcontainITAACthatarenecessaryandsufficienttoprovidereasonableassurancethatthefacilityhasbeenconstructedandwilloperateinaccordancewiththelicense,theAtomicEnergyAct,andNRCregulations.AfterissuanceofaCOL,alicenseecompletesalltheITAACcontainedintheCOLduringconstructionandthensubmitsclosurenotificationletterstotheNRCpursuantto10CFR52.99.TwotypesofITAACnotificationsfromlicenseesarerequiredby10CFR52.99.ThefirsttypeofITAACnotification(ITAACclosureletter)issubmittedunder10CFR52.99(c)(1)andinformstheNRCofthebasisforthelicensee’sdeterminationthatanITAAChasbeensuccessfullycompleted.ITAACclosurelettersmustbesubmittedforallITAAC,withtheexceptionofITAACresolvedatCOLissuanceunder10CFR52.97(a)(2).ThesecondtypeofITAACnotification(uncompleteITAACnotificationletter)issubmittedunder10CFR52.99(c)(2)atleast225daysbeforescheduledinitialfuelloadanddescribeshowalluncompletedITAACwillbesuccessfullycompletedpriortofuelload.Operation(whichincludesloadingfuel)cannotcommenceuntiltheCommissionfindsunder10CFR52.103(g)thatallacceptancecriteriaintheITAACaremet.ToprovideabasisfortheCommission’sfindingandtoensurethatITAACclosurenotificationscontainsufficientinformationtosatisfy10CFR52.99,thelicenseecanfollowindustryguidelineNEI08-01.NEI08-01providesguidanceforlicenseesonmajoraspectsoftheITAACclosureprocessinthefollowingsections:•Introduction•Definitions•GeneralDescriptionof10CFRPart52andITAACProcesses−RoleofITAACin10CFRPart52Process−ITAACClosureProcess−GeneralDescriptionofPu
