1租赁合同TenancyContract2租赁合同TenancyContract出租方(甲方):Landlord(PartyA):承租方(乙方):Tenant(PartyB):甲、乙双方在自愿、平等、互利的基础上,经协商一致,就乙方承租甲方物业事宜,订立本合同。Havingreachedunanimitythroughconsultations,PartyAandPartyB,onthebasisofvoluntariness,equalityandmutualbenefit,haveenteredintothisContractinrespectofPartyAleasingthePremisestoPartyB.一、租赁物业LeasedPremises1.1甲方将坐落于(以下简称‘该物业’)出租给乙方使用,该物业建筑面积为平方米。PartyAlets(hereinafterreferredtothePremises),toPartyB,andthesizeofthePremisesissquaremeters.1.2甲乙双方确定该物业用途为住宅。BothPartyAandPartyBhaveconfirmedthatthePremisesshallbeforthepurposeofResidential.1.3该物业的家俱、家电配置,见本合同附件一。Thefurniture&appliancesofthePremisespleaseseeAppendixI.二、租赁期LeasingTerm2.1本合同租赁期为个月,自年月日起至年月日止。Theleasingtermofthiscontractshallbecalendarmonths,commencingfromto.2.2租赁期满,甲方有权收回该物业,乙方应如期归还;乙方如要求续租,须在3本合同期满前1个月向甲方提出书面申请,经甲方同意后重新签订租赁合同。Onexpiryofthislease,PartyAhastherighttotakebackthePremises,andPartyBshallreturnthePremisesontime.IfPartyBwishestoextendthelease,PartyBisrequiredtogivewrittennoticetoPartyAonemonthspriortotheexpiryoftheleaseandsubjecttoPartyAandPartyB’sconsent,anewleasingcontractshallbesigned.三、租金及保证金RentalandDeposit3.1租金为每月元人民币,租金含物业管理费,发票。Themonthlyrentalispermonth,inclusiveofmanagementfee,formalinvoice。3.2乙方应予签署本合同后五日内向甲方支付相当于一个月租金的金额,即人民币_______元,作为保证金,甲方应出具收据给乙方。在租赁期满,乙方如期交还该物业,并付清居住期间所有租金和其它费用后十五天内,甲方应将保证金无息退还乙方。WithinfivedaysafterthesigningofthisContract,PartyBshallpaytoPartyAasDeposit,whichisequivalenttoonemonths’rental,andPartyAshallissueareceiptforthesaidvalue.AttheexpirationoftheContract,PartyAshallrefundtheDeposittoPartyBwithoutinterestwithin15daysafterPartyBhasreturnedthePremisesandpaidalltherentandotherexpensesforthetermsthatPartyBhasoccupiedthePremises.3.3乙方应在每月日前支付该月租金,若乙方在租金到期后十五天仍未支付,每逾期一天,则乙方应按日租金的支付滞纳金。若超过三十天未付,则视乙方自动退租并构成违约,甲方有权收回该物业,没收保证金并追究相关损失。PartyBshallpaytherentalonorbeforethedayofeachcalendarmonth.IftheRenthasnotbeenpaidwithin15daysofitsduedate,PartyBshallberequiredtopayalatepenaltyfeeequalto______oftherentalperdayforeachdayofdelay.Iftherentalhasnotbeenpaidmorethan30daysaftertheduedate,PartybwillbedeemedtohaveautomaticallyterminatedtheleasingresultinginabreachoftheContract,PartyAwillbeentitledtotakebackthePremises,retaindepositandseekrelatedlosses.3.4甲方在收到租金后五天内应提供给乙方正式发票,若甲方在月底前仍未提供乙方发票,则乙方有权延迟支付下月租金直至收到正式发票。甲方有责任根据税务局和/或房管局的规定、要求和有关程序支付相应的有关租赁房屋的税款。PartyAwillissueanofficialinvoicewithin5daysafterreceivingtherental.IfPartyAhasnotissueanofficialinvoicebytheendofthe4month,PartyBhastherighttodelaythepaymentofthefollowingmonth’srentaluntiltheinvoiceofthesaidmonthisreceived.PartyAisresponsibleforcomplyingwithregulations,requirementsandproceduresoriginatingfromtheTaxBureauand/orHousingBureaurelatedtothetaxesoftherentofthePremises.3.5甲方的银行帐户资料:户名:账号:银行:PartyA’sbankaccountinformation:Name:A/CNo.:Bank:收取租金时,房东的银行所收的手续费由房东支付。TheremittancefeechargedbytheLandlord'sbankforreceivingshouldbepaidbytheLandlord.四、出租人的责任Landlord’sResponsibilities4.1甲方须按时将出租物业及家具电器(见附件一)以良好的状态交付给乙方使用。PartyAshoulddeliveronscheduletheleasedpropertyandthefurnitureandappliances(refertoAppendixI)ingoodconditiontoPartyB.4.2甲方应确保或责成物业管理公司对物业及其公共设施进行定期维修保养,包括4.3但不限于物业内的空调、上下水管、电线电缆、煤气管道、通讯及有线电视等设施,使之处于正常的使用状态。PartyAshouldguaranteeororderthepropertymanagementcompanytocarryoutmaintenanceandrepairofthesaidpremisesandthefacilitiesingoodandproperoperationregularly,includingbutnotrestrictedtoair-conditions,waterpipelines,wiresandcables,gaspipelines,communicationandcableTVetc.4.3房屋基本设施和结构损坏时(不包括乙方损坏的家具和器具),甲方必须在24小时内提供维修服务或给予乙方答复,并承担相关的费用。Incaseofthebasicfacilitiesandstructureofthepremisesbeingdamaged(notincludingfurnitureandappliancesdamagedbyPartyB),PartyAshallrepairorrespondtoPartyB’scomplaintswithin24hours,andbearallcostsrelatedthereto.54.4甲方在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋给乙方。就本合同及出租此房屋于乙方之事,甲方已取得所有有关机构的批准,包括政府批准及抵押权人的同意。甲方于本合同所做出的声明与保证,如有错误或违反者,甲方须就因此而对乙方引起的任何损失、损害、支出及费用对乙方做出全额补偿。PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarycapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinrespectofthisContractandtheleasingofthepropertytoPartyB,includinggovernmentapprovaland/ormortgageconsent.PartyAshallbeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagesincurredandsufferedbyPartyBasaresultofanybreachofPartyA’srepresentationsorwarrantiesherein.4.5如在租赁期内,租赁房屋发生所有权全部或部分转移,和其它影响乙方权益的事情时,甲方应保证所有权人或其它影响乙方权益的第三人,能继续遵守本合同所有条款。如乙方于本合同下的权益受此等所有权人或第三者影响或损害,甲方应负责赔偿乙方的所有损失、损害、支出及费用。Ifduringthetermofthetenancy,allorpartoftheleasedpropertyistransferredorPartyB’srighttouseleasedpropertyisaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB’srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisContract.PartyAshallalsobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamageswhenanyofPartyB’sinterestshereinareaffectedorprejudicedbysuchtransfereeorthirdparty.4.6甲方应负责根据中国法律法规所定因本楼宇租赁而产生的一切税务(包括但不限于房产税,所得税和营业税)和法定费用(包括但不限于土地使用费),并必须将该些税务和法定费用直接向有关税局缴付。TheLandlordshallberesponsibleforandp
