中南民族大学硕士学位论文论网络隐私权的法律保护姓名：王梦萍申请学位级别：硕士专业：法学理论指导教师：王瑞龙20090525IIIIIIAbstractInthepersonalinformationofgreatcommercialvalue,thetraditionalscopeofprivacyhavebeinginaneweraofnetworkexpansion.Internetprivacyviolationsnaturalincreaseinthenumberofcases,thenaturalrighttoprivacyincyberspacewasunprecedentedthreatsandchallenges.Thereisanurgentneedtocarryouteffectivelegalprotection.Ontheotherhand,infringementofprivacyonthenetworkinChinawhetheritisintheory,thelegislativeprotection,orprotectionofthejudicialpracticearelaggingbehind.Inthisregard,theauthor'srighttoprivacyonthenetworkthroughin-depthanalysistolookforanetworkofChina'sprotectionofprivacyintherightpathtoachievebothrespectandprotecttheprivacyinterestsofnaturalpersons,andthepromotionofChina'sInternetindustrytotheprosperityanddevelopmentwithdualpurpose.Thisarticleisdividedintofourparts:Thefirstpartisonananalysisofnetworkprivacyandtheprivacyofthebasictheory.Internetprivacyisanaturalrightonlinewhichisnotenjoyedbyopenlyadvocatingaprivatematter,theprivatesectorwillnotberoomfortheillegalinvasionofanotherperson,freefromanyinterferenceinprivatelifeaswellaspeace-relatedactivitiesandpersonalinformationdataofnetworksareprotected,othersarenotillegaltocollectawareof,reproduce,use,andopentherightpersonality.ItsthemainbodyisnaturalpersonswhoseprovidepersonalinformationonNet.Internetprivacyisanetworkobjectofprivacyisdividedintospecificidentifiablepersonaldatainformation,personalnetworksandnetworkactivitiesandprivatespacefortheprivatesector.PrivacyrightsofInternetcontentinadditiontothenetworktherighttoprivatelifeawayfromthepeaceofpersonaldataincludingthenetwork'srighttoknowinformation,options,maintenanceoftherighttolimittherightsandbenefitsoftheuseoftheright.Privacyisatraditionalnetworkincyberspaceprivacyextension,itwiththetraditionalexclusiverighttoprivacy,objectivityandhiddenfeatures,butalsohaveitsowncharacteristicsofawiderangeofpropertyattributes,themainandtheauthenticityofthevirtualtheexpansionofIVtheobjectanddatacontent,aswellastherighttodiversityandopenness.Thesecondpartisonananalysisofvaluesinthenetworktoprotecttheprivacy.Inreality,thetraditionalprivacyofindividualsaregenerallynotconsideredtohaveeconomicvalue.Thespecificityofthenetworkenvironmenthaschangedcompletelythevalueofattributesofpersonaldata.InternetPrivacyfromthesimplevalueoftheattributesofpersonalitytothepersonalitychangesinboththevalueofpropertyattribute.Attributevalueofthepropertyasanetworkofprivacylawstoprotectindividualandprivatelifeinadditiontothemaintenanceofpeaceandhumandignity,protectionofpersonalitydevelopmentoftheindividualvaluescannotbeignored.Networkoflegalprotectionofprivacyatthesametimereflectstheorderoffreedomandsocialvalue.StrengthenthelegalprotectionofInternetprivacyisnotonlyconducivetopeopleonthenetworktopursuetheirindividualvalue,butalsotobuildanetworkofliberalorderofsocialharmony.ThethirdpartisonananalysisofChina'snetworkoflegalprotectionofprivacythestatusquo.Privacyofournetwork'smainsourcesoflawincludetheConstitution,lawsandadministrativeregulations,locallawsandregulations,aswellasdepartmentalrulesandregulationsoflocalgovernmentsinvolvedinthenetworkoftheprovisionsofprotectionofprivacy.Throughoutthesemajorsourcesoflaw,Ibelievethatthelegalprotectionofprivacytheexistenceofthenetworkone-sidedlegislation,thelackofadirectlackofprotection,independenceandintegrity.PrivacyLegalTheoryResearchNetworklatestartandimmature;thelawislaggingbehindthedevelopmentofthetimescannotmeettherequirementsofthenetwork,aswellastheweaklegalawarenessisthemainreasonfortheseproblems.ThefourthpartistogiveadviceonperfectingthelegalprotectionofInternetprivacy.Theauthordiscussthenetworkestablishedtheprincipleofthelegalprotectionofprivacy,firstthroughtheprincipleofcoordinationbetweentheinterestsofprivacyintheInternetagewiththerighttofreedomofinformation,e-commercenetwork,aswellastherighttoknowthecommunitymanagement,inordertoseekthemosteffectivewaytomaximizethelegalprotectionofInternetprivacy.Personalnetworkinformationthroughofcontrolanddomination,theVprincipleofinformedconsentetctoeffectivelyprotecttheprivacyofeverycitizen'snetwork.AfteracomparativeanalysisintheforeignmodeofInternetprivacyprotection,theauthorconcludedthat:ChinashouldstrengthentheGovernment'sInternetprivacylegislationandestablishindustryself-regulationandtechnicalprotectionmeasures,thegovernmenttoenactlegislationtoprotectthemain,self-disciplineoftheintegratedmodelasasupplement,inadditiontostrengtheningthelegalprotectionofprivacyofthenetworkofinternationalcoordinationandcooperationtoimproveChina'slegalprotectionofInternetprivacy.KeywordsInternetprivacypersonalinformationinformationdatalegislationprotectionindustryself-regulation1______21231.123IP1://
