Subpart360-2:Landfills-Page3(Statutoryauthority:EnvironmentalConservationLaw,Sections1-0101,3-0301,8-0113,19-0301,19-0306,23-2305,23-2307,27-0101,27-0106,27-0107,27-0109,27-0305,27-0703,27-0704,27-0705,27-0911,27-1317,27-1515,52-0107,52-0505,and70-0107)[EffectiveDateDecember31,1988][AmendmentDates:RevisedEffectiveMarch27,1990;withpromulgationofnewSubpart15:GrantsforComprehensiveSolidWasteManagementPlanning.RevisedEffectiveMay28,1991;WithrepealofexistingSubpart9andpromulgationofnewSubpart9:StateAssistanceforMunicipalLandfillClosureProjectsRevisedEffectiveJanuary25,1992;WithrepealofexistingSubpart10andpromulgationofnewSubpart10:RegulatedMedicalWasteStorage,Transfer,andDisposal,andnewSubpart17RegulatedMedicalWasteTreatmentFacilities.Revised/EnhancedEffectiveOctober9,1993;withadoptionofamendmentstoexistingSubparts1through17RevisedEffectiveDecember14,1994;withadoptionofamendmentstoexistingSubpart9:StateAssistanceforMunicipalLandfillClosureProjectsRevisedEffectiveJanuary14,1995;WithrepealofexistingSubpart14andpromulgationofnewSubpart14:UsedOil.RevisedEffectiveNovember26,1996;WithadoptionofamendmentstoexistingSubparts1,2,3,7,11,14,and17RevisedEffectiveSeptember29,1997;WithadoptionofamendmentstoexistingSubpart9RevisedEffectiveNovember21,1998;WithadoptionofamendmentstoexistingSubpart2RevisedEffectiveNovember24,1999;WithadoptionofamendmentstoexistingSubparts2,3,4,5,9,11,14,and16][Thisispage3of3ofthisSubpart.AcompletelistofSubpartsinthisregulationappearsintheChapter4contentspage.]1Contents:Sec.360-2.13Landfillconstructionrequirements.360-2.14Industrial/commercialwastemonofillsandsolidwasteincineratorashresiduemonofills.360-2.15Landfillclosureandpost-closurecriteria.360-2.16Landfillgasrecoveryfacilities.360-2.17Landfilloperationrequirements.360-2.18Landfillreclamation.360-2.19Financialassurancecriteria.360-2.20Correctivemeasuresreport.2§360-2.13Landfillconstructionrequirements.Exceptasotherwiseexpresslyprovidedinsection360-2.14ofthisSubpart,allnewlandfillsandlateralandverticalexpansionsofexistinglandfillsregulatedunderthisSubpartmustconformtotherequirementssetforthinthissection.(a)Horizontalseparationrequirements.(1)Theminimumhorizontalseparationbetweendepositedsolidwasteinthelandfillandthepropertylinemustbe100feet.(2)TherequiredhorizontalseparationbetweendepositedsolidwasteandanysurfacewatersmustbeadequatetoprecludecontraventionofStatesurfacewaterstandardsinthesurfacewaterbody,orfloodingofthelandfillfromthesurfacewaterbody.Innocasecansolidwastebedepositedcloserthan100feetfromthemeanhighwaterelevationofanysurfacewaters.Thedepartmentmayrequiregreaterhorizontalseparationbetweensolidwasteandsurfacewaterswhenthosesurfacewatersareactivelyusedassourcesofmunicipalwatersupply.(b)Surveycontrol.OnepermanentsurveybenchmarkofknownelevationmeasuredfromaU.S.GeologicalSurveybenchmarkmustbeestablishedandmaintainedforeach25acresofdevelopedlandfill,orpartthereof,atthesite.Thisbenchmarkmustbethereferencepointforestablishingverticalelevationcontrol.(c)Locationcoordinates.TheNewYorkTransverseMercator(NYTM)coordinatesmustbeestablished.HorizontalcontrolmustbeestablishedandoneofitspointsmustbethebenchmarkofknownNYTMcoordinates.(d)Groundwaterseparation.Aminimumseparationoffivefeetmustbemaintainedbetweenthebaseoftheconstructedlinersystemandtheseasonalhighgroundwaterelevation.Atsiteswhereperchedwaterisencounteredthedepartmentwilldeterminewithrespecttogroundwaterseparationdistanceswhetherseparationdistanceswillbemeasuredfromtheperchedzoneorthenon-perchedwatertable.Thenatureofthematerialsmakingupthisseparation,whethernaturalorbackfilled,issubjecttodepartmentapproval.Thisminimumfivefeetseparationrequirementmaybereducedorwaivedupondemonstrationofselectionofasuitablelandfillsite,asdefinedundersection360-2.12(a)ofthisSubpart,andupondemonstrationthatcompliancewiththisprovisionwouldimposeanunreasonableeconomic,technological,orsafetyburden;and,thattheproposedactivitywillhavenosignificantadverseimpactontheoverallstabilityofthelandfill,theenvironment,ornaturalresourcesandthatthelandfill'sperformancewillbeconsistentwiththatwhichisexpectedfromtheapplicationofthisPart.Insuchcases,thedepartmentwillrequireadditionalgroundwaterdrainagesystemstoensurethattheseasonalhighgroundwatertabledoesnotcomeincontactwiththelowermostportionofthelandfilllinerduringconstruction,anduntilsuchtimethatthehydrostaticpressuresareequalizedbyweightofthelinersystemand/orwaste.(e)Bedrockseparation.Aminimumof10feetverticalseparationmustbemaintainedbetweenthebaseoftheconstructedlinerandbedrock.Thenatureofthematerialsmakingupthisseparation,whethernaturalorbackfilled,issubjecttodepartmentapproval.(f)Linersystemdescription.Theminimumlinerrequirementforalllandfillsacceptingmixedsolidwastemustconsistofthefollowing:(1)Onallbottomareaswherethelandfillslopeislessthanorequalto25percent,thelinersystemmustconsistofadoublecompositelinerseparatedbyasecondaryleachatecollectionandremovalsystem.(2)Onallsideslopeareaswherethelandfillslopeisgreaterthan25percentthelinersystemneedonlyconsistofaprimary
