-1-外国文教专家标准聘用合同附件(参考样本)（英文）REFERENCESAMPLEOFTHEAPPENDIXOFSTANDARDWORKCONTRACTFORFOREIGNCULTURALANDEDUCATIONALEXPERTSⅠWorkassignment(Thebusinessdepartmentshalllisttheworkassignmentthattheemployedpartyissupposedtoundertakeindetailswithoutsimplification.Thereshallberequirementsonqualityoftheworktheemployedpartyundertakes.)ⅡThesalarytreatment1.DirectpaymentMonetarysalaryRMB/month.ThesalarywillbepaidmonthlywithRMBfromthedayofstartingworktotheexpirationofthecontract.Incasethetimeisshorterthanawholemonth,thepaymentshallbecountedbyday.Thedailywageshallbe1/30ofthemonthlysalary(thesamewithFebruary).Nomorethan70%ofthesalarycanbechangedintoforeigncurrenciesmonthly.TheemployedpartyshallpaythepersonalincometaxinaccordwiththePersonalIncomeTaxLawofThePeople'sRepublicofChina.2.Indirectpayment-2-TheemployingpartywillguaranteethefundamentallivingconditionsfortheemployedpartyinChina:1)Providinglodgingwithfurniture,bedding,telephone,television,refrigerator,toilet,heatingandcoolingfacilities.(Thelodgingprovidedtothepartywhoseemploymenttermislongerthanhalfayear(oronesemester)shallbeequippedwithakitchen.)2)Providingfreemedicalcare.(Theemployingpartyshallpayallthemedicalcostfortheemployedparty.ConsideringthecurrentsalaryleveloftheforeignculturalandeducationalexpertsworkinginChinaandthemedicalcarefeeschargedbyChinesehospitalsforforeigners,theredoesexistconditionsforthemtocoverpartofthemedicalcareexpenses.)Theemployedpartyshouldreceivemedicaltreatmentinthehospitalforeignersappointedbytheemployingparty,otherwise,theexpensesshallbecoveredbytheemployedparty.Expensesforregistration,transportationformedicalcare,toothinlaying,facelifting,massage,glasses,mealsinhospital,tonicsnotformedicalpurpose,anddoctor'shousecallsshallbecoveredbytheemployedparty.3)Providingtransportationtoandfromworkorprovidingpropertransportationallowancefortheemployedpartywhoseworkplaceisfarfromresidence.4)Internationalairticket(internationaleconomyclassairticketforthenearestdistancebetweenChinaandthecountryoftheemployed-3-party)5)Luggagetransportationexpenses(ifbyairtransport,theexpensesshallbecalculatedbyseparatetransportationfor24kilograms,notbythatofaccompanyingtransportation.Alternatively,theexpensescanalsobepaidtotheemployedpartywith1/5oftheinternationalairticketpriceinRMB(roughlyequivalenttotheexpensesforseparatetransportationof24kilograms).SinceairlinesbetweenChinaandtheU.S.stipulatetocarrytwolargepiecesofluggageof64kilogramsforfree,theemployedpartyfromtheUnitedStatesmaynotbeartheluggagetransportationexpenses.ⅢWorkTime,RestandHolidays1.Theworktimeoftheemployedpartyshallbe8hourseveryday,and5dayseveryweek.2.Ifthehostinstitutionarrangesovertimeworkforthepartyemployed,itwillpaytheemployedpartyasalaryhigherthanthatnormalworktimeaccordingtolegalstandard.3.ThepartyemployedisentitledtothefollowingholidaysandfestivalsinChina:NewYear'sDay,SpringFestival,MayDay,NationalDayandotherholidaysstipulatedbylawsandregulations.4.Thepartyemployedisentitledtothefollowingfestivalsandholidayscorrespondingtotheirnationalitiesandreligions:-4-TwodaysforChristmas,threedaysforCorban,onedayforLesserBairamandonedayforWater-splashingFestival.5.Thepartyemployedisentitledtothepaidannualvacation.Employedpartyunderoneyearcontractisentitledtoafourweekpaidvacation.Employedpartyineducationalinstitutionunderoneacademicyearcontractisentitledtoapaid(winterorsummer)vacation.6.AsarulethepartyemployedissupposedtoworkinChinanotlongerthan5continuousyears.ThenextemploymentinChinashouldbetwoyearsafter.ⅣSickleaveandprivateaffairsleave1.Certificatefromdoctorsforforeignersappointedbythehostinstitutionshouldbepresentedwhentheemployedpartyasksforsickleave.Ifthesickleavesamounttolessthan30dayswithinonecontractterm(oneyearoroneacademicyear),thepartyemployedshallbepaidwith100%ofthesalary.Incasetheleavesexceed30days,thehostinstitutionhastherighttoterminatethecontract,or,ifthecontractisnotterminated,the70%ofthesalarywillbepaiduntilthenormalworkisresumed.Duringthetermofthecontract,themedicalcareexpensesoftheemployedpartyinthehospitalforeignersappointedbythelocalgovernmentduringbusinesserrandsshallbepaidbythehostinstitution;themedicalexpensesincurredduringprivatetravelsshallbecoveredby-5-theemployedparty.Duringthetermofthecontract,medicalexpensesincurredinTaiwanprovince,HongKongSAR,MacaoSARandplacesoutsideChinawillbecoveredbytheemployedparty.2.Privateaffairsleaveoftheemployedpartyshallbeapprovedbythehostinstitution.Thehostinstitutionwilldeductthesalarybyday.Inthecontractterm(oneyearoroneacademicyear),theprivateaffairsleavesshouldnotexceed10days.Thecontinuousprivateaffairsleaveshallbenomorethan3days,andtwodays'salarywillbedeductedforeachdaythereafter.Incaseofabsencefromworkwithoutthehostinstitution'spermission,3days'salarywillbedeductedforeachdayabsent.Forseriouscircumstances,thehostinstitutionhastherighttoterminatethecontractandinvestigatetheliabilityoftheemployedpartyforviolationofthecontract.ⅤTheProbationperiodoftheContractandtheCreditBail1.Theprobationperiodoftheemployedpartyshallbe60days.Intheprobationperiod,iftheho
