1DIRECTIVE2014/68/EUOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCIL2014/68/EU指令2014年5月15日发布ontheharmonisationofthelawsoftheMemberStatesrelatingtothemakingavailableonthemarketofpressureequipment依据各成员国有关法律统一制作，适用于压力设备市场THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,andinparticularArticle114thereof,havingregardtotheproposalfromtheEuropeanCommission,aftertransmissionofthedraftlegislativeacttothenationalparliaments,havingregardtotheopinionoftheEuropeanEconomicandSocialCommittee,Actinginaccordancewiththeordinarylegislativeprocedure欧洲议会和欧盟理事会，根据欧盟运作条约，特别是第114条款，考虑到来自欧洲委员会的建议，将立法法案草案传给国家议会后，根据欧洲经济和社会委员会的意见，按照普通立法程序，Whereas:鉴于：(1)Directive97/23/ECoftheEuropeanParliamentandoftheCouncilhasbeensubstantiallyamended.Sincefurtheramendmentsaretobemade,thatDirectiveshouldberecastintheinterestsofclarity.（1）欧洲议会和理事会的97/23/EC指令已大幅修订。既然进一步的修订需要作出，该指令需要重新制定，以清晰说明。(2)Regulation(EC)No765/2008oftheEuropeanParliamentandoftheCouncillaysdownrulesontheaccreditationofconformityassessmentbodies,providesaframeworkforthemarketsurveillanceofproductsandforcontrolsonproductsfromthirdcountries,andlaysdownthegeneralprinciplesoftheCEmarking.（2）欧洲议会和理事会条例(EC)No765/2008制定了有关合格评定机构认可的规则，为产品的市场监管及来自第三国家的产品控制提供了一个框架，并规定了CE标识的总则。(3)DecisionNo768/2008/ECoftheEuropeanParliamentandoftheCouncil(6)laysdowncommonprinciplesandreferenceprovisionsintendedtoapplyacrosssectorallegislationinordertoprovideacoherentbasisforrevisionorrecastsofthatlegislation.Directive97/23/ECshouldthereforebeadaptedtothatDecision.（3）根据欧洲议会和理事会第768/2008/EC决议，规定了了共同的原则和旨在适用于部门立法的参考条款，为立法提供统一的修订或重新制定基础。因此97/23/EC指令亦应符合这一决议。(4)ThisDirectivecoverspressureequipmentandassemblieswhicharenewtotheUnionmarketwhentheyareplacedonthemarket;thatistosaytheyareeithernewpressureequipmentorassembliesmadebyamanufacturerestablishedintheUnionorpressureequipmentorassemblies,whetherneworsecond-hand,importedfromathirdcountry.2（4）本指令包含了新投入欧盟市场的压力设备和组件，也就是说，他们或是一个新的压力设备或由欧盟制造商所组装的组件，或是从第三国进口的压力设备和组件，无论是新设备还是二手的。(5)ThisDirectiveshouldapplytoallformsofsupply,includingdistanceselling.（5）本指令适用于包括远程销售的所有形式供应。(6)ThisDirectiveshouldapplytopressureequipmentsubjecttoamaximumallowablepressurePSgreaterthan0.5bar.Pressureequipmentsubjecttoapressureofnotmorethan0,5bardoesnotposeasignificantriskduetopressure.Therefore,thereshouldnotbeanyobstacletoitsfreemovementwithintheUnion.（6）本指令应适用于最大允许压力（PS）大于0.5Bar的压力设备。最大允许压力不超过0.5Bar的压力设备不存在重大压力风险。因此，此类产品在欧盟内自由流通不应该有任何阻碍。(7)ThisDirectiveshouldalsoapplytoassembliescomposedofseveralpiecesofpressureequipmentassembledtoconstituteanintegratedandfunctionalwhole.Thoseassembliesmayrangefromsimpleassembliessuchaspressurecookerstocomplexassembliessuchaswatertubeboilers.Ifthemanufacturerofanassemblyintendstoplaceitonthemarketandputitintoserviceasanassembly—andnotintheformofitsconstituentnon-assembledelements—thatassemblyshouldcomplywiththisDirective.However,thisDirectiveshouldnotapplytotheassemblyofpressureequipmentonthesiteandundertheresponsibilityofauserwhoisnotthemanufacturer,asinthecaseofindustrialinstallations.（7）本指令也适用于由几件压力设备组装成的，构成一个功能整体的组合件。这些组合件从简单组合件（如压力锅）到复杂组合件（如水管锅炉）。如果组合件的制造商计划将它作为组合件（作为一个整体，而不是以组成部分的形式）投入市场，该组合件也应符合本指令。但是，该指令不适用于如工业建造情形下的现场压力设备装配，也不适用由于不是制造商的使用者。(8)ThisDirectiveshouldharmonisenationalprovisionsonrisksduetopressure.TheotherriskswhichthisequipmentmaypresentmayfallwithinthescopeofotherDirectivesdealingwiththoserisks.（8）本指令应符合国家规定的压力产生的风险。本产品所面临的其他风险可能属于其他处理这些风险指令的范围。(9)However,somepressureequipmentiscoveredbyotherDirectivesbasedonArticle114oftheTreatyontheFunctioningoftheEuropeanUnion(TFEU).TheprovisionslaiddowninsomeofthoseDirectivesdealalsowiththeriskduetopressure.ThoseDirectivesareconsideredadequatetoprovideappropriateprotectionwheretheriskduetopressureassociatedwithsuchequipmentremainssmall.Therefore,suchequipmentshouldbeexcludedfromthescopeofthisDirective.（9）然而，一些压力设备属于根据欧盟运作条约（TFEU）第114条运作的其他指令。在这些指令中也规定了处理由于压力产生的风险。由于涉及到这些设备的压力很小，可以认为这些指令足以对压力风险提供适当的保护。因此，这类设备应排除在本指令范围内。3(10)Forsomepressureequipmentcoveredbyinternationalagreementsforitsinternationaltransport,nationaltransportandpressurehazardsandrisksaredealtwithbyUnionDirectivesbasedonsuchagreements.ThoseDirectivesextendtheapplicationofthoseagreementstonationaltransport,inordertoensurethefreemovementofdangerousgoodswhilstenhancingtransportsafety.SuchequipmentwhichiscoveredbyDirective2008/68/ECoftheEuropeanParliamentandoftheCouncilandbyDirective2010/35/EUoftheEuropeanParliamentandoftheCouncilshouldbeexcludedfromthescopeofthisDirective.（10）对于一些由于国际或国内运输，压力风险已经被国际协议所涵盖的压力设备，欧盟指令依照国际协议进行。这些指令将这些协议的应用扩展到国内运输，确保危险货物的自由流动的同时提高运输安全。因此，那些依据欧洲议会和理事会2008/68/EC和2010/35/EU指令所覆盖的设备应排除在本指令的范围内。(11)Certaintypesofpressureequipment,althoughsubjecttoamaximumallowablepressurePSgreaterthan0,5bar,donotpresentanysignificantriskduetopressure,andthereforethefreemovementofsuchequipmentintheUnionshouldnotbehinderedifithasbeenlegallymanufacturedorplacedonthemarketinaMemberState.ItisnotnecessaryinordertoensurefreemovementofsuchequipmenttoincludeitwithinthescopeofthisDirective.Cons
