員工僱傭合約本僱傭合約由XXXXXX訂立,於2013年4月1日以書面形式確認2013年04月01日開始生效的口頭僱傭合約。雙方同意後,決定重新訂立僱傭合約,遵守下列僱傭條款及條件:ThisemploymentcontractismadebyandbetweenconfirminginwritingonApril1,2013theoralemploymentcontracteffectivefromApril1,2013.Thepartiesagreetore-enterintoanemploymentcontract,subjecttothefollowingtermsandconditionsofemployment1.受僱日期由2013年04月01日起生效,直至任何一方終止合約為止。Thedateofemploymentshallbeeffectivefrom04/01/2013untiltheterminationofthecontractbyeitherparty2.受僱職位总经理Generalmanageremployed3.工作地點香港告士打道50號馬來西亞大廈3樓302室,及僱主指定的其他地點。Placeofwork:Room302,3/F.,MalaysiaBuilding.50GloucesterRoad,HongKong,andsuchotherplacesasmaybedesignatedbytheemployer.4.工作時間每星期一至星期五上午九時至六時,或僱主秘書(以下簡稱秘書)所指定的其他時間,合共不多於四十小時(不包括每日一小時用膳時間)。超時工作一小時可按1比1.1的方式獲超時補假,補假在超時工作後的下月內補放。補假不應累積多於四十小時,若超過四十小時,僱員需通知秘書或副主席,經雙方協商後,由職員會追認或作彈性處理。Workinghoursofnotmorethan40hours(excludingonehourofdailymealbreaks)perweekdayfrom9:00a.m.to6:00a.m.orsuchotherhoursasmaybedesignatedbytheemployer'ssecretary(hereinafterreferredtoasthesecretary).Overtimeleavewillbegrantedattherateof1:1.1foronehourofovertimework,whichwillbepaidwithinthenextmonthaftertheovertimework.Nomorethan40hoursofcompensatoryleaveshallbeaccumulated.Incaseofanymorethan40hours,theemployeeshallnotifythesecretaryorthedeputychairmanand,uponmutualagreement,thestaffshallendorseorgiveflexibility.5.工資每月$11000,於每年支付壹次。秘書於次年5月前須提出檢討僱員薪酬福利,須先諮詢僱員意見,然後在職員會討論後在執委會於7月前確認。Salary:$11,000permonth,payableonceayear.Thesecretaryshallproposeareviewofemployees'payandbenefitsbymayofthefollowingyear.ThesecretaryshallconsultwiththeemployeesfirstandconfirmthereviewbyJulyafterdiscussionatstaffmeetings.6.休息日每7天工作期間可享有不少於2天休息日,當休息日與法定假期重疊,秘書需另定一天補假。星期日為指定休息日,除非秘書另作指示。Restdaysnotlessthan2restdayswillbegrantedforevery7workingdays.Whentherestdaysoverlapwithstatutoryholidays,thesecretaryshallmakeupanotherdayofleave.Sundaysaredesignatedrestdaysunlessotherwiseinstructedbythesecretary.7.假期僱員享有按《僱傭條例》規定的法定假日及公眾假期。Holidayemployeesareentitledtostatutoryholidaysandpublicholidaysundertheemploymentordinance8.有薪年假僱員享有一年十四天的年假。除非經僱主同意,僱員工作滿一年始可領取上一個工作年的年假,並需於隨後的工作年度內清假,不可累積。放假安排由僱員與秘書或副主席協商,職員會(由主席、副主席、財政和各僱員組成)決定或追認。Paidannualleaveemployeesareentitledtofourteendays'annualleaveayear.Anemployeeisentitledtoannualleaveforthepreviousworkingyearuntilhe/shehascompletedoneyearofemploymentwiththeconsentofhis/heremployer.Leavearrangementsaremadebytheemployeeinconsultationwiththesecretaryorthevice-chairman,anddeterminedorendorsedbythestaffassociation(comprisingthechairman,vice-chairman,treasurerandeachemployee).9.產假薪酬僱員可根據《僱傭條例》的規定享有產假及全薪產假薪酬。Maternityleavepayemployeesareentitledtomaternityleaveandmaternityleavepaywithfullpayundertheemploymentordinance.10.陪產假男性僱員在試用期滿後,如伴侶懷孕,須通知秘書或副主席及遞交醫生証明副本,說明預產期,即享有總數共七天全薪的陪產假。在伴侶預產期的兩個星期至產後的兩個星期以內可申請發放陪產假。陪產假亦適用於伴侶流產的情況。Paternityleavemaleemployeesarerequiredtonotifythesecretaryorvicechairmanandsubmitacopyofthedoctor'scertificatestatingtheduedateofdelivery,i.e.atotalofsevendaysofpaternityleavewithfullpay,iftheirpartnerbecomespregnantaftertheexpiryoftheirprobationperiod.Paternityleavecanbeappliedforbetweentwoweeksofthepartner'sduedateandtwoweeksafterdelivery.Paternityleavealsoapplieswhenapartnermiscarries.11.病假及疾病津貼僱員病假一天以下不需病假証明書,並享有全薪病假。一天或以上均享有全薪病假。申請病假須具中西醫或牙醫簽發的病假証明書,始獲全薪的病假津貼。Sickleaveandsicknessallowanceemployeeswhohavebeensickforlessthanonedaydonotneedasickleavecertificateandareentitledtofullpaysickleave.Fullpaysickleaveforonedayormore.Toapplyforsickleave,asickleavecertificateissuedbyadoctoroftraditionalChineseandwesternmedicineoradentistisrequiredtobeeligibleforfullpaysickleaveallowance.12.試用期僱員試用期為三個月。在試用期第一個月,雙方終止本合約不需要通知期;在試用期第二個月及第三個月,任何一方終止本合約需要七天通知,或支付相等於通知期限的工資。Theprobationaryperiodofanemployeeisthreemonths.Inthefirstmonthoftheprobationperiod,thereisnonoticeperiodforbothpartiestoterminatethiscontract;Duringthesecondandthirdmonthsoftheprobationperiod,sevendays'noticeorwagesequivalenttotheperiodofnoticeshallberequiredforeitherpartytoterminatethisagreement13.終止僱傭合約試用期後,任何一方終止本合約則需要一個月通知,或支付相等於通知期限的工資。Aftertheterminationoftheprobationperiod,eitherpartyshallberequiredtogiveonemonth'snoticeorpaywagesequaltotheperiodofnotice.14.強制性公積金計劃僱員根據《強制性公積金計劃條例》的規定參予強制性公積金計劃。僱主及僱員依照《強制性公積金計劃條例》的規定向計劃供款。Mandatoryprovidentfundschemesemployeesparticipateinmandatoryprovidentfundschemesunderthemandatoryprovidentfundschemesordinance.Employersandemployeesmakecontributionstoschemesunderthemandatoryprovidentfundschemesordinance15.颱風時當值當八號或以上風球懸掛時,僱員無須上班,工資不會被扣減。當八號或以上風球於下班前不少於四小時前除下,僱員須要上班。Whentyphoonsignalno.8oraboveishoisted,employeesarenotrequiredtogotoworkandtheirwagesarenotdeducted.Employeesarerequiredtogotoworkwhenthesignalno.8oraboveislowerednotlessthan4hoursbeforetheendofbusiness.16.黑雨警告時當值當黑色暴雨警告生效期間,僱員無須上班,工資不會被扣減。當黑色暴雨警告於下班前不少於四小時前除下,僱員須要上班。Whentheblackrainstormwarningisineffect,employeesarenotrequiredtogotoworkandtheirwagesarenotdeducted.Employeesarerequiredtogotoworkwhentheblackrainstormwarningislowerednotlessthan4hoursbeforetheendofbusiness.17.醫療費用津貼僱員獲聘用,即時獲得醫療費用津貼二千元,實報實銷。僱員受僱期間,於每年一月一日獲得醫療費用津貼二千元,實報實銷。Medicalexpenseallowancean
