Tuesday,January5,2010PartVIIThePresidentExecutiveOrder13526—ClassifiedNationalSecurityInformationMemorandumofDecember29,2009—ImplementationoftheExecutiveOrder‘‘ClassifiedNationalSecurityInformation’’OrderofDecember29,2009—OriginalClassificationAuthorityVerDateNov24200817:28Jan04,2010Jkt220001PO00000Frm00001Fmt4717Sfmt4717E:\FR\FM\05JAE0.SGM05JAE0srobinsononDSKHWCL6B1PRODwithMISCELLANEOUSVerDateNov24200817:28Jan04,2010Jkt220001PO00000Frm00002Fmt4717Sfmt4717E:\FR\FM\05JAE0.SGM05JAE0srobinsononDSKHWCL6B1PRODwithMISCELLANEOUSPresidentialDocuments707FederalRegisterVol.75,No.2Tuesday,January5,2010Title3—ThePresidentExecutiveOrder13526ofDecember29,2009ClassifiedNationalSecurityInformationThisorderprescribesauniformsystemforclassifying,safeguarding,anddeclassifyingnationalsecurityinformation,includinginformationrelatingtodefenseagainsttransnationalterrorism.OurdemocraticprinciplesrequirethattheAmericanpeoplebeinformedoftheactivitiesoftheirGovernment.Also,ourNation’sprogressdependsonthefreeflowofinformationbothwithintheGovernmentandtotheAmericanpeople.Nevertheless,throughoutourhistory,thenationaldefensehasrequiredthatcertaininformationbemaintainedinconfidenceinordertoprotectourcitizens,ourdemocraticinstitutions,ourhomelandsecurity,andourinteractionswithforeignnations.ProtectinginformationcriticaltoourNation’ssecurityanddemonstratingourcommitmenttoopenGovernmentthroughaccurateandaccountableapplicationofclassificationstandardsandroutine,secure,andeffectivedeclassificationareequallyimportantpriorities.NOW,THEREFORE,I,BARACKOBAMA,bytheauthorityvestedinmeasPresidentbytheConstitutionandthelawsoftheUnitedStatesofAmerica,itisherebyorderedasfollows:PART1—ORIGINALCLASSIFICATIONSection1.1.ClassificationStandards.(a)Informationmaybeoriginallyclassi-fiedunderthetermsofthisorderonlyifallofthefollowingconditionsaremet:(1)anoriginalclassificationauthorityisclassifyingtheinformation;(2)theinformationisownedby,producedbyorfor,orisunderthecontroloftheUnitedStatesGovernment;(3)theinformationfallswithinoneormoreofthecategoriesofinformationlistedinsection1.4ofthisorder;and(4)theoriginalclassificationauthoritydeterminesthattheunauthorizeddisclosureoftheinformationreasonablycouldbeexpectedtoresultindamagetothenationalsecurity,whichincludesdefenseagainsttransnationalterrorism,andtheoriginalclassificationauthorityisabletoidentifyordescribethedamage.(b)Ifthereissignificantdoubtabouttheneedtoclassifyinformation,itshallnotbeclassified.Thisprovisiondoesnot:(1)amplifyormodifythesubstantivecriteriaorproceduresforclassifica-tion;or(2)createanysubstantiveorproceduralrightssubjecttojudicialreview.(c)Classifiedinformationshallnotbedeclassifiedautomaticallyasaresultofanyunauthorizeddisclosureofidenticalorsimilarinformation.(d)Theunauthorizeddisclosureofforeigngovernmentinformationispre-sumedtocausedamagetothenationalsecurity.Sec.1.2.ClassificationLevels.(a)Informationmaybeclassifiedatoneofthefollowingthreelevels:(1)‘‘TopSecret’’shallbeappliedtoinformation,theunauthorizeddisclo-sureofwhichreasonablycouldbeexpectedtocauseexceptionallygravedamagetothenationalsecuritythattheoriginalclassificationauthorityisabletoidentifyordescribe.(2)‘‘Secret’’shallbeappliedtoinformation,theunauthorizeddisclosureofwhichreasonablycouldbeexpectedtocauseseriousdamagetotheVerDateNov24200817:28Jan04,2010Jkt220001PO00000Frm00003Fmt4705Sfmt4790E:\FR\FM\05JAE0.SGM05JAE0srobinsononDSKHWCL6B1PRODwithMISCELLANEOUS708FederalRegister/Vol.75,No.2/Tuesday,January5,2010/PresidentialDocumentsnationalsecuritythattheoriginalclassificationauthorityisabletoidentifyordescribe.(3)‘‘Confidential’’shallbeappliedtoinformation,theunauthorizeddisclo-sureofwhichreasonablycouldbeexpectedtocausedamagetothenationalsecuritythattheoriginalclassificationauthorityisabletoidentifyordescribe.(b)Exceptasotherwiseprovidedbystatute,noothertermsshallbeusedtoidentifyUnitedStatesclassifiedinformation.(c)Ifthereissignificantdoubtabouttheappropriatelevelofclassification,itshallbeclassifiedatthelowerlevel.Sec.1.3.ClassificationAuthority.(a)Theauthoritytoclassifyinformationoriginallymaybeexercisedonlyby:(1)thePresidentandtheVicePresident;(2)agencyheadsandofficialsdesignatedbythePresident;and(3)UnitedStatesGovernmentofficialsdelegatedthisauthoritypursuanttoparagraph(c)ofthissection.(b)Officialsauthorizedtoclassifyinformationataspecifiedlevelarealsoauthorizedtoclassifyinformationatalowerlevel.(c)Delegationoforiginalclassificationauthority.(1)Delegationsoforiginalclassificationauthorityshallbelimitedtotheminimumrequiredtoadministerthisorder.Agencyheadsareresponsibleforensuringthatdesignatedsubordinateofficialshaveademonstrableandcontinuingneedtoexercisethisauthority.(2)‘‘TopSecret’’originalclassificationauthoritymaybedelegatedonlybythePresident,theVicePresident,oranagencyheadorofficialdes-ignatedpursuanttoparagraph(a)(2)ofthissection.(3)‘‘Secret’’or‘‘Confidential’’originalclassificationauthoritymaybedelegatedonlybythePresident,theVicePresident,anagencyheadorofficialdesignatedpursuanttoparagraph(a)(2)ofthissection,ort
