Issue1241Standard4.2.1STANDARD4.2.1PRIMARYPRODUCTIONANDPROCESSINGSTANDARDFORSEAFOOD(Australiaonly)PurposeandcommentaryThisStandardsetsoutfoodsafetyandsuitabilityrequirementsforseafoodgenerallyfrompre-harvestingproductionoftheseafoodupto,butnotincludingmanufacturingoperations.Chapter3ofthisCodeappliestoseafoodmanufacturingandretailsaleactivities.UnderthisStandard,aseafoodbusinessmustidentifypotentialseafoodsafetyhazardsandimplementcontrolsthatarecommensuratewiththerisk.Additionally,thisStandardrequiresprimaryproducersandprocessorsofcertainbivalvemolluscstoimplementafoodsafetymanagementsystem.Thisparticularrequirementalsoextendstomanufacturingactivitiesrelatingtobivalvemolluscs.Forprimaryproducersandprocessorsofbivalvemolluscs,thefoodsafetymanagementsystemincorporatesconditionsontheareasfromwhichtheproductmaybeharvestedorharvestedfordepurationorrelaying,alongwithconditionsonthewaterusedforwetstorage.TableofProvisionsDivision1–Preliminary1Application2InterpretationDivision2–Generalseafoodsafetyrequirements3Generalseafoodsafetymanagement4Contaminationandhandling5Inputsandharvestingareas6Seafoodstorage7Seafoodtransportation8Seafoodpackaging9Seafoodfordisposal10Seafoodreceipt11Seafoodtracing12Skillsandknowledge13Healthandhygienerequirements14SeafoodpremisesandequipmentDivision3–Harvestingandotherrequirementsforbivalvemolluscs15Interpretation16Foodsafetymanagementsystemsforbivalvemolluscs17Co-minglingofbivalvemolluscsClausesDivision1–Preliminary1Application(1)ThisStandardappliestoseafoodbusinessesandseafoodhandlersinAustraliabutnotinNewZealand.FederalRegisterofLegislativeInstrumentsF2012C00775Issue1242Standard4.2.1(2)UnlessthecontraryintentionappearsinthisStandard,Chapter3ofthisCodeappliestoseafoodmanufacturingandretailsaleactivities.Editorialnote:ThisStandardappliestoprimaryproductionandprocessingactivitiesasdefinedinclause2.Thedefinitionof‘processingofseafood’includesactivitiessuchasthekilling,gutting,filleting,briningandshuckingofseafoodandthedepurationofshellfish.However,otherthanthefoodsafetymanagementsystemrequirementsforbivalvemolluscs,thisStandarddoesnotapplytomanufacturingactivities.Manufacturingofseafoodisdefinedinclause2asthecanning,smokingorcrumbingoftheseafoodortheadditionofotherfoodstotheseafoodandotherlikeactivities.UndertheImportedFoodControlAct1992,StandardsinthisCodeapplytoimportedfood.However,thisStandarddoesnotfallwithinthescopeofthe‘AgreementBetweentheGovernmentofAustraliaandtheGovernmentofNewZealandConcerningaJointFoodStandardsSystem’.Accordingly,thisStandarddoesnotapplytofoodbusinessesinNewZealand.Furthermore,theTrans-TasmanMutualRecognitionArrangementandtheAustralianandNewZealandlegislationgivingeffecttothatArrangementapplytoimportedfood.ThisStandarddoesnotapplytopersonswhoharvestorcatchseafoodforrecreational,culturalortraditionalpurposes,providedtheactivitydoesnotcomewithinthedefinitionofa‘seafoodbusiness’–thatis,theseafoodharvestedortakenisnotintendedforsale.Clause3ofthisStandarddoesnotaffecttheoperationofStandard3.2.1.2Interpretation(1)Unlessthecontraryintentionappears,thedefinitionsinChapter3ofthisCodeapplyforthepurposesofthisStandard.(2)InthisStandard–controlmeansameasurethatprevents,eliminatesorreducestoanacceptablelevel,afoodsafetyhazard.depurationmeansaprocessusingacontrolledenvironmenttoreducethelevelofcertainpathogenicorganismsthatmaybepresentinliveshellfishandcrustaceans.harvestingmeansthecaptureortakingofseafoodandincludesthecaptureortakingofseafoodfromanenclosureorpondusedinaquaculture.inputsincludesanyfeed,chemicalsorothersubstancesusedin,orinconnectionwith,theprimaryproductionofseafood.liveseafoodpremisesmeansapremisesusedfortheprimaryproductionofliveseafood,andincludesseacages.manufacturingofseafoodmeansthecanning,smokingorcrumbingofseafoodortheadditionofotherfoodtoseafoodandotherlikeactivities.primaryproductionofseafoodmeansthe–(a)growing,cultivation,picking,harvesting,collectionorcatchingofseafood;or(b)growingonofseafood;or(c)transportationordeliveryofseafood;or(d)holdingofliveseafood;andincludesprocessingofseafood.FederalRegisterofLegislativeInstrumentsF2012C00775Issue1243Standard4.2.1processingofseafoodincludes–(a)thekilling,dismembering,filletingorcuttingintoportions,gillorgutting,orskinningofseafood;and(b)thedepurationofshellfishandcrustaceans;and(c)theshuckingorpeelingofseafood;and(d)thecooking,includingsteamingorboiling,ofcrustaceans;and(e)thebriningofseafood;and(f)thepacking,treating,washing,freezing,refrigerationorstoringofseafood;and(g)othersimilaractivities.Editorialnote:Thedefinitionsof‘primaryproductionofseafood’and‘processingofseafood’operateforthepurposesofthisStandardanddonotaffectthedefinitionofthosetermsinStateandTerritoryFoodActs.ThedefinitionsinthisStandarddonotaffectthelegislativeoradministrativearrangementsintheStatesandTerritoriesconcerningtheadministrationandimplementationoflegislativeschemes.seafoodmeansallaquaticvertebratesandaquaticinvertebratesintendedforhumanconsumption,butexcludesamphibians,mammals,reptiles,andaquaticplants.seafoodbusinessmeans
