1/1/82INSTITUTECARGOCLAUSES(A)RISKSCOVERED1.Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasprovidedinClauses4,5,6and7below.2.Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofaffreightmentand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses4,5,6and7orelsewhereinthisinsurance.3.ThisinsuranceisextendedtoindemnifytheAssuredagainstsuchproportionofliabilityunderthecontractofaffreightmentBothtoBlameCollisionClauseasisinrespectofalossrecoverablehereunder.IntheeventofanyclaimbyshipownersunderthesaidClausetheAssuredagreetonotifytheUnderwriterswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.EXCLUSIONS4.Innocaseshallthisinsurancecover4.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured4.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured4.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingorpreparationofthesubject-matterinsured(forthepurposeofthisClause4.3packingshallbedeemedtoincludestowageinacontainerorliftvanbutonlywhensuchstowageiscarriedoutpriortoattachmentofthisinsuranceorbytheAssuredortheirservants)4.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured4.5lossdamageorexpenseproximatelycausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst(exceptexpensespayableunderClause2above)4.6lossdamageorexpensearisingfrominsolvencyorfinancialdefaultoftheownersmanagerscharterersoroperatorsofthevessel4.7lossdamageorexpensearisingfromtheuseofanyweaponofwaremployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.5.5.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfromunseaworthinessofvesselorcraft,unfitnessofvesselcraftconveyancecontainerorliftvanforthesafecarriageofthesubject-matterinsured,wheretheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein.5.2TheUnderwriterswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination,unlesstheAssuredortheirservantsareprivytosuchunseaworthinessorunfitness.6.Innocaseshallthisinsurancecoverlossdamageorexpensecausedby6.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower6.2captureseizurearrestrestraintordetainment(piracyexcepted),andtheconsequencesthereoforanyattemptthereat6.3derelictminestorpedoesbombsorotherderelictweaponsofwar.7.Innocaseshallthisinsurancecoverlossdamageorexpense7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions7.3causedbyanyterroristoranypersonactingfromapoliticalmotive.DURATION8.8.1Thisinsuranceattachesfromthetimethegoodsleavethewarehouseorplaceofstorageattheplacenamedhereinforthecommencementofthetransit,continuesduringtheordinarycourseoftransitandterminateseither8.1.1ondeliverytotheConsignees'orotherfinalwarehouseorplaceofstorageatthedestinationnamedherein,8.1.2ondeliverytoanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedherein,whichtheAssuredelecttouseeither8.1.2.1forstorageotherthanintheordinarycourseoftransitor8.1.2.2forallocationordistribution,or8.1.3ontheexpiryof60daysaftercompletionofdischargeoversideofthegoodsherebyinsuredfromtheoverseavesselatthefinalportofdischarge,whichevershallfirstoccur.8.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thegoodsaretobeforwardedtoadestinationotherthanthattowhichtheyareinsuredhereunder,thisinsurance,whilstremainingsubjecttoterminationasprovidedforabove,shallnotextendbeyondthecommencementoftransittosuchotherdestination.8.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforaboveandtotheprovisionsofClause9below)duringdelaybeyondthecontroloftheAssured,anydeviation,forceddischarge,reshipmentortransshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtoshipownersorcharterersunderthecontractofaffreightment.9.IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageisterminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwiseterminatedbeforedeliveryofthegoodsasprovidedforinClause8above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheUnderwritersandcontinuationofcoverisrequestedwhentheinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheUnderwriters,either9.1untilthegoodsaresoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthegoodsherebyinsuredatsuchportorplace,whichevershallfirstoccur,or9.2ifthegoodsareforwardedwithinthesaidperiodof60days(oranyagreedextensionthereof)tothedestinationnamedhereinortoanyotherdestination,untilterminatedinaccordancewiththeprovisions
