Revision1109姓名:___________________日期:________1EMPLOYMENTCONTRACTFORFOREIGNCONSTRUCTIONWORKERSINTHEREPUBLICOFSINGAPORE雇佣外籍建筑工人合同(一劳)ThisEmploymentContract(雇佣合同)ismadebetween兹由(1)________________________________________________________havingitsregisteredaddressat:________________________________________________________(hereinafterreferredtoasthe“Employer”)ononepartand(以下简称雇主,为一方,与):Name(姓名)Nationality(国籍)DateofBirth(出生日期)IdentificationNo.(身份证号码)Address(家庭住址)(hereinafterreferredtoasthe“Employee”)ontheotherpartwhovoluntarilybindthemselvestothetermsandconditionsinthisemploymentcontract(以下简称为雇员,作为另一方,自愿达成以下雇佣条款):ITISHEREBYAGREEDTHATthisemploymentcontract,whichincludesthetermsandconditionsstatedinAnnexAandanydocumentsreferredtointhemandanyalterations,modifications,amendmentsorrevisionstothesamenotifiedbytheEmployertotheEmployeeformthecontractofemploymentbetweentheEmployerandtheEmployee:同时,本雇佣合同也包括附件A及其提及的文件内容以及在执行过程中根据情况对这些内容进行的补充、修改和完善,并相应通知雇员。1.GeneralPrinciple(总则)1.1TheEmploymentContractistobesignedbytheEmployeeunderhisnotionandcommonunderstanding.Andithasbeenstudiedbyhimselfandconsideredcarefullyunderhisownsanityandhisfamily’spermission.本雇佣合同书是雇员在充分理解的基础上签订的。雇员在签署时,神智清醒,无任何压力或引诱,并已取得家属支持后,经多次阅读和反复思考,完全自愿签署的。1.2AfterthisContractissigned,theemploymentrelationshipwillbeestablished.AndRevision1109姓名:___________________日期:________2itshouldbethebehaviorstandardoftheemployee’s.Anybreachforit,theEmployeewillaccepttherelativepenaltyforhisowndeeds.本合同签署后,雇员的一切言行必须以本合同为准则,若有违反,雇员自愿受罚。2.Task(工作安排)2.1TheEmployermayattheirabsolutediscretionassigntheEmployeeinadifferenttrade/taskfromtimetotime.TheEmployerreservestheirrighttoadjusttheEmployee’spayaccordinglyiftheEmployeeisunableand/orisincompetenttocarryouttheassignedtrade/task.雇主有权根据需要将雇员安排在另一个职位工作。同时,雇主保留因雇员不能胜任工作而对其工资进行调整的权利。2.2TheEmployeeshouldbephysicallyhealthyandpassallthemedicalcheckbyauthorizeddoctorsinSingapore.Andtheemployeeshouldbeaqualifiedconstructionworkerthatcanworkatheights,bearheat,andanyothertoughworkingenvironmentonsite.雇员必须身体健康,能通过新加坡医院和诊所组织的体检。雇员必须是合格的建筑工人,工作时做到能吃苦,不怕晒,不怕热、适应在高空、基坑或海上工作,能够从事各项建筑施工。3.DutiesofEmployee(雇员职责)3.1JobTitle(工作职位)ConstructionWorker建筑工人3.2Location(工作地点)AnyoftheworksitesdesignatedbytheEmployerwithintheRepublicofSingapore.新加坡共和国内任何一个雇主指定的工地。3.3WorkingTime(工作时间)TheworkingtimeshouldbedecidedbytheemployeeaccordingthelawofSingapore.雇员的工作时间按照新加坡的雇佣法由雇主决定。3.4TheemployeeshouldfollowtheregulationsandinstructionbytheEmployer.Anyabsenceforworkwithoutavalidreason,theEmployercouldgivethefineofS$50.00.Iftheabsenceaccumulatedto3days,theEmployercouldperformtherightandrepatriatetheEmployee.Revision1109姓名:___________________日期:________3雇员必须服从雇主的领导与管理。对于旷工的雇员,雇主可处以每天50.00新币的旷工罚款。连续旷工3天者,雇主可以取消其准证并遣送回国。4.Contractperiod(合同期)4.1Thecontractperiodisfortwo(2)years(theactualdaysshouldbaseontheEmployee’sWorkPermitandTemporaryWorkPermitentitledbyMinistryofManpower,butshouldnotlessthan730days).Alltheemployeesshallstrictlyfollowthis2years’contractperiod.Otherwise,theEmployeeshallcompensatetotheEmployeraccordingtotherelativeclauseofthisEmploymentContract.本合同雇佣期为两年(实际天数以新加坡人力部授予雇员的工作准证和临时工作准证为准,但总天数不得少于730天)),雇员务必严格遵守。否则,根据本雇佣合同相应条款,给予雇主补偿。4.2Uponcompletionofthefirstyear’semployment,theEmployermayattheirabsolutediscretiondecidenottorenewtheworkpermitforthesecondaryyearwithoutgivinganyreasonandwithoutbeingliableforanycompensationtotheEmployee.在第一年雇佣期满后,雇主根据工作需要及雇员的工作表现,为雇佣办理工作准证延期。雇主有权辞退不合格的雇员,而不需给予原因和补偿。4.3IftheEmployeerefusestocomplywiththistwo(2)years’contractperiod,theEmployeeshallberesponsibleforhisownrepatriationcoststohisdomesticcountryandallthecompensationtotheEmployerwhichmaybepaidfromtheEmployee’ssalary.如果雇员在雇佣期内拒绝履行为期两年的雇佣合同,雇员必须自己承担相关遣返费用和对雇主的赔偿。该费用由雇员从其工资中直接支付给雇主。4.4Uponcompletionofthistwoyear’semployment,itcouldbeextendundertheconsensusbetweentheEmployerandtheEmployee.两年雇佣期满,如果雇主与雇员双方同意,可以延长合同期限。5.WorkPermit(工作准证)TheEmployeeshallhandoverhisoriginaltravel/passportdocumentsandWorkPermittotheEmployerduringtheemploymentintheRepublicofSingaporeforprocessing.雇员在到达新加坡的雇佣之日起,应将其护照及工作准证等有关原始证件交给雇主保管。6.Salary(工资)Thesalarycouldbecalculatedonpieceworksystemandtimeratesystem.雇主将根据实际工作情况及工作条件将工资制度分为计件工资与计时工资两种6.1PieceworkSystem计件工资制TheEmployee’ssalaryshallbecalculatedstrictlyonpieceworksystem.Pieceworksystemshalladoptthefollowingquotarate(S$)whichmayberevisedoradjustedRevision1109姓名:___________________日期:________4bytheEmployerattheirabsolutediscretionfromtimetotime.AnyrevisionoradjustmentofthepieceworkratesperunitstatedbelowwillbenotifiedtotheEmployeefromthesupervisors:(a)Timberformwork4.00-8.00/m2(b)Metalformwork4.00-8.00/m2(c)Rebar50.00-120.00/ton(d)Bricklaying2.00—3.50/m2(e)Plastering1.50—3.00/m2(f)Tiling5.00—8.00/m2(g)Concrete3.00—9.00/m2雇员在新加坡的工资收入严格按计件工资制计算。计件工资按以下定额单价(新元为单位)执行:木模4.00-8.00/平方米铁模4.00-8.00/平方米钢筋50.00-120.00/吨砌砖2.00—3.50/平方米抹灰1.50—3.00/平方米瓷砖5.00—8.00/平方米砼3.00—9.00/平方米雇主将根据实际情况对以上定额单价进行调整和修改并相应通知雇员。6.1.1Basedontheabovesystem,theEmployeesunderfullattendancewouldbeclassifyinto4classesthattheEmployeecanperformhisdutiescompetently,efficiently,safely
