LABORCONTRACT员工劳动合同NAME:姓名：POSITION:职位：DATE:日期：年月日LABORCONTRACT劳动合同书PARTYA甲方：LegalRepresentativeorAuthorizedAgent法定代表人或委托代理人：LegallyRegisteredAddress:黄浦区泰康路210弄5号3503室PARTYB乙方：Education文化程度：Sex性别：IDNo.身份证号码：ResidentialAddress:联络地址：ZipCode邮政编码：IPCAdvertisement(Shanghai)Co.,Ltd(hereinafterreferredtoaspartyA)engages(HereinafterreferredtoaspartyB)astheemployeeunderthelabourcontractsystemofthiscompany.艾皮思广告（上海）有限公司（以下简称甲方）现聘用(以下简称乙方）为本公司劳动合同制员工。Thiscontractissignedbetweentwopartiesbasedontheprinciplesofequality,voluntaryandconsensusinaccordancewiththeLabourLawofthePeople’sRepublicofChinaandotherrelevantlawsandregulationsofthestateaswellasarticlesofassociationofthiscompany.双方根据《中华人民共和国劳动法》、《上海市劳动合同条例》及国家其它有关法律法规，以及本公司章程，本着平等、自愿、协商一致的原则，签订本合同。Article1Contractdurationandprobationaryperiod第1条合同期限、试用期限1.Thecontractisvalidfor,fromto.Upontheexpirationofthecontract,itcanbere-signedbymutualagreement.Thecontractcanalsobemodifiedbasedonmutualagreementbyperformingrelevantformality.AnadditionalcontractoragreementneedstobesignedontheconditionthattheemployeegetsthetrainingpaidbypartyAortakesspecialwelfarefromthecompany.1、本合同有效期为年，自起，至止。合同到期时，经双方同意可以续订本合同。经双方同意可以对本合同作出修改并履行有关手续、如是甲方出资培训的、享受公司特别福利待遇等员工，双方需要另行签定有关合同或协议。2.Thiscontractmayberenewed30dayspriorexpirationupontheconsultationandagreementofbothparties.2、甲乙双方于期限届满之前三十天经协商同意,可以续订劳动合同。Article2Workingpostandduty第二条工作岗位、工作职责1.PartyAarrangespartyBtoworkatitsShanghaiOfficeas)andpartyBmustfinishthearrangedjobintime,inqualityandinquantityinaccordancewiththeHRManualandSystemofPersonnelResponsibilityspecifiedbypartyA.1、甲方安排乙方在上海办公室担任_____________________________.工作，乙方必须按照甲方规定的《员工手册》，岗位责任制度，按时、按质、按量完成工作。2.PartyAcantransferpartyBtoanotherpostinaccordancewithrequirementsofproductionoperationandmanagementaswellaspartyB’sworkingabilityandbehaviour.PartyBhastherighttoreporttopartyA’smanagementauthorityonhis/heropinion,buthastoobeythearrangementwithoutwrittenconsentfrompartyA.2、甲方根据生产经营管理需要和乙方的工作能力、工作表现，可调动乙方的工作岗位。乙方有向甲方管理部门反映本人意见的权利，但未经甲方书面批准答复，必须服从调动。Article3Labourremuneration第三条劳动报酬1.AspercurrentsalarysystemofpartyA,monthlysalarybeforetaxforpartyBisRMB.PartyAwilldeductincometax,socialinsuranceandhousefoundingforpartyB.PartyAensuresthatpartyBwillreceivehis/hersalaryonthe30thdayofeachmonth.1、按甲方现行工资制度，乙方工资为税前人民币元。甲方根据国家有关规定代扣代缴所得税，社保及公积金。甲方确定每月30日发薪。2.PartyAcanadjustpartyB’ssalarylevelaccordingtothefollowingfactors:2、甲方在以下情况下可对乙方的工资待遇予以调整：a)PartyAshallmakeanevaluationtopartyBforhis/herachievementeachyearbefore12/31,andhastherighttoadjustpartyB’ssalarylevelandbonusaccordingtotheresultsofevaluation.a）甲方于每年12月31日之前，对乙方进行一次业绩评审，甲方有权根据评审结果调整乙方的工资水平和奖金。b)OntheconditionthatPartyAbecomesdeficitowingtothedifficultyinmanufactureandmanagement.b）在甲方因生产经营发生困难出现亏损时。c)PartyAcanadjustpartyB’ssalaryandtreatmentaccordingtopresentsalarysystemincasechangeshappenedinPartyB’sworkingpostandrank.c）在乙方的工作岗位、职位发生变化时，甲方可依现行的工资制度对乙方的工资待遇予以调整。Article4Welfare第四条福利待遇1.PartyBcanenjoy15days’officialholidays(4dayforNewYear,4daysforChineseNewYear,1dayforTombSweepingFestival,1dayforLabourDay,1dayforDragonBoatFestival,1dayforMid-autumnFestivaland3daysforNationalDay)andanyotherholidayseachyearstipulatedbythestate.1、乙方每年享有十一天国家法定休假（元旦四天，春节四天，清明节一天，劳动节一天，端午节一天，中秋节一天，国庆节三天）及国家规定的其他休假。2.PartyAprovidespartyBwithwelfareandinsuranceinaccordancewiththeApplicableLaw.TherelevantdetailsofwelfarebenefitsofPartyBaremadeasappendixestothisAgreement,whichisattachedandwillcomeintoeffectprovidedwiththesignatureofbothpartieshereto.3、甲方为乙方提供法律规定的福利保险。乙方福利的具体细节将作为本合同的附件，于双方签署后生效。4.PartyBcantakesickleavesstipulatedbythestateduringhis/herworkingperiodowingtohis/hersicknessorinjuryoutofjobwhichneedstostopworkingformedicaltreatment.Thestipulationformedicaltreatmentperiodandsalaryduringsickleaveswillbecarriedoutaccordingtorelevantregulationsbythestate.4、乙方在甲方工作期间，因患病或非因工负伤、需要停止工作接受治疗的，可享受国家规定的医疗期。该医疗期的规定和病假期间工资的发放参照国家有关规定执行。Article5Labourdisciplineandreward&punishment第五条劳动纪律及奖惩1.PartyBshouldobservelawsandregulationsofthestate.1、乙方应遵守国家的法律、法规。2.PartyBshouldbeonworkandoffworkontime.ShouldpartyBrequirealeaveofabsence,partyBshallapplyforleaveasperstipulationmadebypartyA.AlsopartyBshallstrictlyobeyalltherulesandregulationsdrawnlawfullybypartyA.2、乙方应按时上下班，如因故不能出勤者，应按甲方规定申请相应的假期。乙方必须严格遵守甲方依法制订的各项规章制度。3.PartyAwillpunishthediscipline-violatedemployeesbasedonstipulation;andawardtheemployeeswhostrictlyobservetherulesandregulationsofpartyAbasedonstipulation.3、对于违反规章制度的员工，甲方按规定予以处罚；对于模范遵守甲方规章制度的员工，甲方按规定予以奖励。Article6DutyandobligationofpartyB第六条乙方的职责和义务1.PartyAcarriesout5-dayworkingsystemwith40workinghoursperweek.PartyAhastherighttodecidespecifiedworkingtimeandholidayforpartyB.Intheeventofrequirementofjob,partyAcancarryoutunfixedworkingtimesystemorcomprehensivecalculatingworkingtimesystemandotherworkingandholidaymethodsubjecttoapprovalbyrelevantauthority.1、甲方每周实行五天工作制，乙方每周工作时间为40小时。甲方有权决定乙方具体的工作时间及休息日。若因工作需要，甲方可以实行不定时工作制或综合计算工时工作制等其他工作和休息办法，并报主管部门审批。2.RequiringpartyBtodoovertimeworkduetodemandofproductionorbusiness,partyAshallarrangepartyBforholidayorpayovertimewage
