EuropeanTreatySeries-No.5ConventionfortheProtectionofHumanRightsandFundamentalFreedoms,asamendedbyProtocolsNo.11and14Rome,4.XI.1950TextamendedbytheprovisionsofProtocolNo.14(CETSNo.194)asfromthedateofitsentryintoforceon1June2010.ThetextoftheConventionhadbeenpreviouslyamendedaccordingtotheprovisionsofProtocolNo.3(ETSNo.45),whichenteredintoforceon21September1970,ofProtocolNo.5(ETSNo.55),whichenteredintoforceon20December1971andofProtocolNo.8(ETSNo.118),whichenteredintoforceon1January1990,andcomprisedalsothetextofProtocolNo.2(ETSNo.44)which,inaccordancewithArticle5,paragraph3thereof,hadbeenanintegralpartoftheConventionsinceitsentryintoforceon21September1970.AllprovisionswhichhadbeenamendedoraddedbytheseProtocolswerereplacedbyProtocolNo.11(ETSNo.155),asfromthedateofitsentryintoforceon1November1998.Asfromthatdate,ProtocolNo.9(ETSNo.140),whichenteredintoforceon1October1994,wasrepealedandProtocolNo.10(ETSno.146)hadlostitspurpose.2Thegovernmentssignatoryhereto,beingmembersoftheCouncilofEurope,ConsideringtheUniversalDeclarationofHumanRightsproclaimedbytheGeneralAssemblyoftheUnitedNationson10thDecember1948;ConsideringthatthisDeclarationaimsatsecuringtheuniversalandeffectiverecognitionandobservanceoftheRightsthereindeclared;ConsideringthattheaimoftheCouncilofEuropeistheachievementofgreaterunitybetweenitsmembersandthatoneofthemethodsbywhichthataimistobepursuedisthemaintenanceandfurtherrealisationofhumanrightsandfundamentalfreedoms;Reaffirmingtheirprofoundbeliefinthosefundamentalfreedomswhicharethefoundationofjusticeandpeaceintheworldandarebestmaintainedontheonehandbyaneffectivepoliticaldemocracyandontheotherbyacommonunderstandingandobservanceofthehumanrightsuponwhichtheydepend;Beingresolved,asthegovernmentsofEuropeancountrieswhicharelike-mindedandhaveacommonheritageofpoliticaltraditions,ideals,freedomandtheruleoflaw,totakethefirststepsforthecollectiveenforcementofcertainoftherightsstatedintheUniversalDeclaration,Haveagreedasfollows:Article1–ObligationtorespecthumanrightsTheHighContractingPartiesshallsecuretoeveryonewithintheirjurisdictiontherightsandfreedomsdefinedinSectionIofthisConvention.SectionI–RightsandfreedomsArticle2–Righttolife1Everyone'srighttolifeshallbeprotectedbylaw.Nooneshallbedeprivedofhislifeintentionallysaveintheexecutionofasentenceofacourtfollowinghisconvictionofacrimeforwhichthispenaltyisprovidedbylaw.2Deprivationoflifeshallnotberegardedasinflictedincontraventionofthisarticlewhenitresultsfromtheuseofforcewhichisnomorethanabsolutelynecessary:aindefenceofanypersonfromunlawfulviolence;binordertoeffectalawfularrestortopreventtheescapeofapersonlawfullydetained;cinactionlawfullytakenforthepurposeofquellingariotorinsurrection.Article3–ProhibitionoftortureNooneshallbesubjectedtotortureortoinhumanordegradingtreatmentorpunishment.Article4–Prohibitionofslaveryandforcedlabour1Nooneshallbeheldinslaveryorservitude.32Nooneshallberequiredtoperformforcedorcompulsorylabour.3Forthepurposeofthisarticletheterm“forcedorcompulsorylabour”shallnotinclude:aanyworkrequiredtobedoneintheordinarycourseofdetentionimposedaccordingtotheprovisionsofArticle5ofthisConventionorduringconditionalreleasefromsuchdetention;banyserviceofamilitarycharacteror,incaseofconscientiousobjectorsincountrieswheretheyarerecognised,serviceexactedinsteadofcompulsorymilitaryservice;canyserviceexactedincaseofanemergencyorcalamitythreateningthelifeorwell-beingofthecommunity;danyworkorservicewhichformspartofnormalcivicobligations.Article5–Righttolibertyandsecurity1Everyonehastherighttolibertyandsecurityofperson.Nooneshallbedeprivedofhislibertysaveinthefollowingcasesandinaccordancewithaprocedureprescribedbylaw:athelawfuldetentionofapersonafterconvictionbyacompetentcourt;bthelawfularrestordetentionofapersonfornon-compliancewiththelawfulorderofacourtorinordertosecurethefulfilmentofanyobligationprescribedbylaw;cthelawfularrestordetentionofapersoneffectedforthepurposeofbringinghimbeforethecompetentlegalauthorityonreasonablesuspicionofhavingcommittedanoffenceorwhenitisreasonablyconsiderednecessarytopreventhiscommittinganoffenceorfleeingafterhavingdoneso;dthedetentionofaminorbylawfulorderforthepurposeofeducationalsupervisionorhislawfuldetentionforthepurposeofbringinghimbeforethecompetentlegalauthority;ethelawfuldetentionofpersonsforthepreventionofthespreadingofinfectiousdiseases,ofpersonsofunsoundmind,alcoholicsordrugaddictsorvagrants;fthelawfularrestordetentionofapersontopreventhiseffectinganunauthorisedentryintothecountryorofapersonagainstwhomactionisbeingtakenwithaviewtodeportationorextradition.2Everyonewhoisarrestedshallbeinformedpromptly,inalanguagewhichheunderstands,ofthereasonsforhisarrestandofanychargeagainsthim.3Everyonearrestedordetainedinaccordancewiththeprovisionsofparagraph1.cofthisarticleshallbebroughtpromptlybeforeajudgeorotherofficerauthorisedbylawtoexercisejudicialpowerandshallbeentitledtotrialwithinareasonabletimeortoreleasependingtrial.Releasemaybeconditionedbyguaranteestoappearfortrial.4Everyonewhoisdeprivedofhislibertybyarrestordetentionshallbeent
