LanguageReferenceGuideNetLinxProgrammingNetLinxProgrammingLanguageLastRevised:8/13/2009SoftwareLicenseandWarrantyAgreement•LICENSEGRANT.AMXgrantstoLicenseethenon-exclusiverighttousetheAMXSoftwareinthemannerdescribedinthisLicense.TheAMXSoftwareislicensed,notsold.ThislicensedoesnotgrantLicenseetherighttocreatederivativeworksoftheAMXSoftware.TheAMXSoftwareconsistsofgenerallyavailableprogramminganddevelopmentsoftware,productdocumenta-tion,sampleapplications,toolsandutilities,andmiscellaneoustechnicalinformation.PleaserefertotheREADME.TXTfileonthecompactdiscordownloadforfurtherinformationregardingthecomponentsoftheAMXSoftware.TheAMXSoftwareissub-jecttorestrictionsondistributiondescribedinthisLicenseAgreement.AMXDealer,Distributor,VIPorotherAMXauthorizedentityshallnot,andshallnotpermitanyotherpersonto,disclose,display,loan,publish,transfer(whetherbysale,assignment,exchange,gift,operationoflaworotherwise),license,sublicense,copy,orotherwisedisseminatetheAMXSoftware.Licenseemaynotreverseengineer,decompile,ordisassembletheAMXSoftware.•ACKNOWLEDGEMENT.YouherebyacknowledgethatyouareanauthorizedAMXdealer,distributor,VIPorotherAMXautho-rizedentityingoodstandingandhavetherighttoenterintoandbeboundbythetermsofthisAgreement.•INTELLECTUALPROPERTY.TheAMXSoftwareisownedbyAMXandisprotectedbyUnitedStatescopyrightlaws,patentlaws,internationaltreatyprovisions,and/orstateofTexastradesecretlaws.LicenseemaymakecopiesoftheAMXSoftwaresolelyforbackuporarchivalpurposes.LicenseemaynotcopythewrittenmaterialsaccompanyingtheAMXSoftware.•TERMINATION.AMXRESERVESTHERIGHT,INITSSOLEDISCRETION,TOTERMINATETHISLICENSEFORANYREA-SONUPONWRITTENNOTICETOLICENSEE.IntheeventthatAMXterminatesthisLicense,theLicenseeshallreturnordestroyalloriginalsandcopiesoftheAMXSoftwaretoAMXandcertifyinwritingthatalloriginalsandcopieshavebeenreturnedordestroyed.•PRE-RELEASECODE.PortionsoftheAMXSoftwaremay,fromtimetotime,asidentifiedintheAMXSoftware,includePRE-RELEASECODEandsuchcodemaynotbeatthelevelofperformance,compatibilityandfunctionalityoftheGAcode.ThePRE-RELEASECODEmaynotoperatecorrectlyandmaybesubstantiallymodifiedpriortofinalreleaseorcertainfeaturesmaynotbegenerallyreleased.AMXisnotobligatedtomakeorsupportanyPRE-RELEASECODE.ALLPRE-RELEASECODEISPROVIDEDASISWITHNOWARRANTIES.•LIMITEDWARRANTY.AMXwarrantsthattheAMXSoftware(otherthanpre-releasecode)willperformsubstantiallyinaccor-dancewiththeaccompanyingwrittenmaterialsforaperiodofninety(90)daysfromthedateofreceipt.AMXDISCLAIMSALLOTHERWARRANTIES,EITHEREXPRESSORIMPLIED,INCLUDING,BUTNOTLIMITEDTOIMPLIEDWARRANTIESOFMERCHANTABILITYANDFITNESSFORAPARTICULARPURPOSE,WITHREGARDTOTHEAMXSOFTWARE.THISLIM-ITEDWARRANTYGIVESLICENSEESPECIFICLEGALRIGHTS.AnysupplementsorupdatestotheAMXSOFTWARE,includingwithoutlimitation,any(ifany)servicepacksorhotfixesprovidedtoLicenseeaftertheexpirationoftheninety(90)dayLimitedWarrantyperiodarenotcoveredbyanywarrantyorcondition,express,impliedorstatutory.•LICENSEEREMEDIES.AMX'sentireliabilityandLicensee'sexclusiveremedyshallberepairorreplacementoftheAMXSoft-warethatdoesnotmeetAMX'sLimitedWarrantyandwhichisreturnedtoAMXinaccordancewithAMX'scurrentreturnpolicy.ThisLimitedWarrantyisvoidiffailureoftheAMXSoftwarehasresultedfromaccident,abuse,ormisapplication.Anyreplace-mentAMXSoftwarewillbewarrantedfortheremainderoftheoriginalwarrantyperiodorthirty(30)days,whicheverislonger.OutsidetheUnitedStates,theseremediesmaynotavailable.NOLIABILITYFORCONSEQUENTIALDAMAGES.INNOEVENTSHALLAMXBELIABLEFORANYDAMAGESWHATSOEVER(INCLUDING,WITHOUTLIMITATION,DAMAGESFORLOSSOFBUSINESSPROFITS,BUSINESSINTERRUPTION,LOSSOFBUSINESSINFORMATION,ORANYOTHERPECUNIARYLOSS)ARISINGOUTOFTHEUSEOFORINABILITYTOUSETHISAMXSOFTWARE,EVENIFAMXHASBEENADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES.BECAUSESOMESTATES/COUNTRIESDONOTALLOWTHEEXCLUSIONORLIMITATIONOFLIABILITYFORCONSEQUENTIALORINCIDENTALDAMAGES,THEABOVELIMITA-TIONMAYNOTAPPLYTOLICENSEE.•U.S.GOVERNMENTRESTRICTEDRIGHTS.TheAMXSoftwareisprovidedwithRESTRICTEDRIGHTS.Use,duplication,ordisclosurebytheGovernmentissubjecttorestrictionsassetforthinsubparagraph©(1)(ii)ofTheRightsinTechnicalDataandComputerSoftwareclauseatDFARS252.227-7013orsubparagraphs©(1)and(2)oftheCommercialComputerSoftwareRestrictedRightsat48CFR52.227-19,asapplicable.•SOFTWAREANDOTHERMATERIALSFROMAMX.COMMAYBESUBJECTTOEXPORTCONTROL.TheUnitedStatesExportControllawsprohibittheexportofcertaintechnicaldataandsoftwaretocertainterritories.NosoftwarefromthisSitemaybedownloadedorexported(i)into(ortoanationalorresidentof)Cuba,Iraq,Libya,NorthKorea,Iran,Syria,oranyothercoun-trytowhichtheUnitedStateshasembargoedgoods;or(ii)anyoneontheUnitedStatesTreasuryDepartment'slistofSpeciallyDesignatedNationalsortheU.S.CommerceDepartment'sTableofDenyOrders.AMXdoesnotauthorizethedownloadingorexportingofanysoftwareortechnicaldatafromthissitetoanyjurisdictionprohibitedbytheUnitedStatesExportLaws.ThisAgreementreplacesandsupersedesallpreviousAMXSoftwareLicenseAgreementsandisgovernedbythelawsoftheStateofTexas,andalldisputeswillberesolvedinthecourtsinCollinCounty,Texas,USA.Foranyque
