I(ActsadoptedundertheECTreaty/EuratomTreatywhosepublicationisobligatory)DIRECTIVESCOMMISSIONDIRECTIVE2008/58/ECof21August2008amending,forthepurposeofitsadaptationtotechnicalprogress,forthe30thtime,CouncilDirective67/548/EEContheapproximationofthelaws,regulationsandadministrativeprovisionsrelatingtotheclassification,packagingandlabellingofdangeroussubstances(TextwithEEArelevance)THECOMMISSIONOFTHEEUROPEANCOMMUNITIES,HavingregardtotheTreatyestablishingtheEuropeanCommu-nity,HavingregardtoCouncilDirective67/548/EECof27June1967ontheapproximationofthelaws,regulationsandadministrativeprovisionsrelatingtotheclassification,packagingandlabellingofdangeroussubstances(1),andinparticularArticle28thereof,Whereas:(1)AnnexItoDirective67/548/EECcontainsalistofdangeroussubstances,togetherwithparticularsoftheclassificationandlabellingofeachsubstance.Thatlistneedstobeupdatedtoincludefurthernotifiednewsubstancesandfurtherexistingsubstances,aswellastoadaptcertainentriestotechnicalprogress.Inaddition,itisnecessary,inthatAnnex,todeleteentriesforcertainsubstances.Theclassificationandlabellingofsubstancescontainingbenzeneshouldbechangedinordertoreflectthatbenzeneisclassifiedasamutagenandsomeentriesshouldbesplitbecausethenewlyaddedorrevisedphysico-chemicalclassificationnolongerappliestoallthesubstancesunderthoseentries.(2)TheclassificationandlabellingofthesubstanceslistedinthisDirectiveshouldbereviewedifnewscientificknowl-edgebecomesavailable.Inthisrespect,consideringrecentpreliminary,partialandnotpeer-reviewedinformationsubmittedbyindustry,specialattentionshouldbepaidtofurtherresultsofepidemiologicalstudiesontheBoratesconcernedbythisDirectiveincludingtheongoingstudyconductedinChinaandtheoutcomeoftheIARCdiscussionoftheclassificationofNickelsubstancesoranynewrelevantscientificfindingsorinterpretationsgiventothedatausedtoestablishthecurrentproposalsfortheNickelcompoundsconcernedbythisDirective.(3)CertainnotesintheforewordofAnnexIshouldbeamendedoraddedtoclarifytheobligationsonmanufac-turers,distributorsandimportersofcertainsubstances,toreflectthatbenzenehas,inadditiontoothereffects,beenclassifiedasmutagenic,andtoreflectthattheclassificationandlabellinginAnnexIrelatingtophysico-chemicalpropertiesneednotbeappliedwhentestingshowsthatthespecificformofasubstancemarketedhasdifferentphysico-chemicalproperties.Note6intheforewordofAnnexIshouldbedeletedastheprovisionsofthisnotenolongerapplyfromthedateonwhichCommissionDirective2001/60/EC(2)entersintoforce.Consequently,thereferencetoNote6shouldbedeletedfromcertainentriesintheAnnex.AnewNote7shouldbeaddedtotheforewordofAnnexItoreflectthatalloyscontainingnickelaretobeclassifiedforsensitisationonthebasisoftheirreleaserateratherthanontheconcentrationofnickel.(4)ThemeasuresprovidedforinthisDirectiveareinaccordancewiththeopinionoftheCommitteeontheAdaptationtoTechnicalProgressoftheDirectivesfortheEliminationofTechnicalBarrierstoTradewithDangerousSubstancesandPreparations,15.9.2008ENOfficialJournaloftheEuropeanUnionL246/1(1)OJL196,16.8.1967,p.1.(2)OJL226,22.8.2001,p.5.HASADOPTEDTHISDIRECTIVE:Article1AnnexIofDirective67/548/EECisamendedasfollows:1.theforewordisamendedasfollows:(a)NoteHisreplacedbythetextsetoutinAnnex1A;(b)NoteJisreplacedbythetextsetoutinAnnex1B;(c)NotePisreplacedbythetextsetoutinAnnex1C;(d)ThetextsetoutinAnnex1DisaddedasNoteT;(e)Note6isdeleted;(f)ThetextsetoutinAnnex1EisaddedasNote7;2.theentriescorrespondingtotheentriessetoutinAnnex1FarereplacedbytheentriessetoutinthatAnnex;3.TheentriessetoutinAnnex1GtothisDirectiveareinsertedinaccordancewiththeorderoftheentriessetoutinAnnexItoDirective67/548/EEC;4.TheentriessetoutinAnnex1HtothisDirectivearedeleted.Article21.MemberStatesshallbringintoforcethelaws,regulationsandadministrativeprovisionsnecessarytocomplywiththisDirectiveby1June2009atthelatest.TheyshallforthwithcommunicatetotheCommissionthetextofthoseprovisionsandacorrelationtablebetweenthoseprovisionsandthisDirective.WhenMemberStatesadoptthoseprovisions,theyshallcontainareferencetothisDirectiveorbeaccompaniedbysuchareferenceontheoccasionoftheirofficialpublication.MemberStatesshalldeterminehowsuchreferenceistobemade.2.MemberStatesshallcommunicatetotheCommissionthetextofthemainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirective.Article3ThisDirectiveshallenterintoforceonthe20thdayfollowingthatofitspublicationintheOfficialJournaloftheEuropeanUnion.Article4ThisDirectiveisaddressedtotheMemberStates.DoneatBrussels,21August2008.FortheCommissionStavrosDIMASMemberoftheCommissionL246/2ENOfficialJournaloftheEuropeanUnion15.9.2008ANNEX1A‘NoteH:Theclassificationandlabelshownforthissubstanceappliestothedangerousproperty(ies)indicatedbytheriskphrase(s)incombinationwiththecategory(ies)ofdangershown.Themanufacturers,distributorsandimportersofthissubstanceshallbeobligedtocarryoutaninvestigationtomakethemselvesawareoftherelevantandaccessibledatawhichexistsforallotherpropertiestoclassifyandlabelthesubstance.Thefinallabelshallfollowtherequirementsofsection7ofAnnexVIofthisDirective.’ANNEX1B‘NoteJ:Th
