ChinaPacificPropertyInsuranceCompanyLimitedOceanMarineCargoClausesSpecialNotice:ThisEnglishversionisforyourkindreferenceonly.PleaserefertoourChineseversion,whichisfiledinCIRC,asastandardpolicywording.1CHINAPACIFICPROPERTYINSURANCECOMPANYLIMITEDOCEANMARINECARGOCLAUSESI.ScopeofCoverThisinsuranceisclassifiedintothefollowingthreeConditions-FreefromParticularAverage(F.P.A.),WithAverage(W.A.)andAllRisks.Wherethegoodsinsuredhereundersustainlossordamage,theCompanyshallundertaketoindemnifythereforeaccordingtotheInsuredConditionspecifiedinthePolicyandtheProvisionsoftheseClauses:1.FreeFromParticularAverage(F.P.A.)Thisinsurancecovers:(1)TotalorConstructiveTotalLossofthewholeconsignmentherebyinsuredcausedinthecourseoftransitbynaturalcalamities—heavyweather,lightning,tsunami,earthquakeandflood.Incaseaconstructivetotallossisclaimedfor,theInsuredshallabandontotheCompanythedamagedgoodsandallhisrightsandtitlepertainingthereto.Thegoodsoneachlightertoorfromtheseagoingvesselshallbedeemedaseparaterisk.“ConstructiveTotalLoss”referstothelosswhereanactualtotallossappearstobeunavoidableorthecosttobeincurredinrecoveringorreconditioningthegoodstogetherwiththeforwardingcosttothedestinationnamedinthePolicywouldexceedtheirvalueonarrival.(2)TotalorPartialLosscausedbyaccidents—thecarryingconveyancebeinggrounded,stranded,sunkorincollisionwithfloatingiceorotherobjectsasfireorexplosion.(3)Partiallossoftheinsuredgoodsattributabletoheavyweather,lightningand/ortsunami,wheretheconveyancehasbeengrounded,stranded,sunkorburnt,irrespectiveofwhethertheeventoreventstookplacebeforeoraftersuchaccidents.(4)Partialortotallossconsequentonfallingofentirepackageorpackagesintoseaduringloading,transhipmentordischarge.(5)ReasonablecostincurredbytheInsuredinsalvagingthegoodsoravertingorminimizingalossrecoverableunderthePolicy,providedthatsuchcostshallnotexceedthesuminsuredoftheconsignmentsosaved(6)Lossesattributabletodischargeoftheinsuredgoodsataportofdistressfollowingaseaperilaswellasspecialchargesarisingfromloading,warehousingandforwardingofthegoodsatanintermediateportofcallorrefuge.(7)SacrificeinandContributiontoGeneralAverageandSalvageCharges.(8)Suchproportionoflossessustainedbytheship-ownersasistobereimbursedbytheCargoOwnerundertheContractofAffreightment“BothtoBlameCollision”Clause.2.WithAverage(W.A.)AsidefromtheriskscoveredunderF.P.A.conditionasabove,thisinsurancealsocoverspartiallossesoftheinsuredgoodscausedbyheavyweather,lightning,tsunami,earthquakeand/orflood.3.AllRisksAsidefromtheriskscoveredundertheF.P.A.andW.A.conditionsasabove,thisinsurancealsocoversallrisksoflossofordamagetotheinsuredgoodswhetherpartialortotal,arisingfromexternalcausesinthecourseoftransit.II.ExclusionsChinaPacificPropertyInsuranceCompanyLimitedOceanMarineCargoClausesSpecialNotice:ThisEnglishversionisforyourkindreferenceonly.PleaserefertoourChineseversion,whichisfiledinCIRC,asastandardpolicywording.2Thisinsurancedoesnotcover:1、LossordamagecausedbytheintentionalactorfaultoftheInsured.2、Lossordamagefallingundertheliabilityoftheconsignor.3、Lossordamagearisingfromtheinferiorqualityorshortageoftheinsuredgoodspriortotheattachmentofthisinsurance.4、Lossordamagearisingfromnormalloss,inherentviceornatureoftheinsuredgoods,lossofmarketand/ordelayintransitandanyexpensesarisingtherefrom.5、RisksandliabilitiescoveredandexcludedbytheOceanMarineCargoWarRisksClausesandStrike,RiotandCivilCommotionClausesofthisCompany.III.CommencementandTerminationofCover1、WarehousetoWarehouseClause:ThisinsuranceattachesfromthetimethegoodsherebyinsuredleavethewarehouseorplaceofstoragenamedinthePolicyforthecommencementofthetransitandcontinuesinforceintheordinarycourseoftransitincludingsea,landandinlandwaterwaytransitsandtransitinlighteruntiltheinsuredgoodsaredeliveredtotheconsignee’sfinalwarehouseorplaceofstorageatthedestinationnamedinthePolicyortoanyotherplaceusedbytheInsuredforallocationordistributionofthegoodsorforstorageotherthanintheordinarycourseoftransit.Thisinsuranceshall,however,belimitedtosixty(60)daysaftercompletionofdischargeoftheinsuredgoodsfromtheseagoingvesselatthefinalportofdischargebeforetheyreachtheabovementionedwarehouseorplaceofstorage.Ifpriortotheexpiryoftheabovementionedsixty(60)days,theinsuredgoodsaretobeforwardedtoadestinationotherthanthatnamedinthePolicy,thisinsuranceshallterminateatthecommencementofsuchtransit.2、Ifowingtodelay,deviation,forceddischarge,reshipmentortranshipmentbeyondthecontroloftheInsuredoranychangeorterminationofthevoyagearisingfromtheexerciseofalibertygrantedtotheship-ownersunderthecontractofaffreightment,theinsuredgoodsarriveataportorplaceotherthanthatnamedinthePolicy,subjecttoimmediatenoticebeinggiventotheCompanybytheInsuredandanadditionalpremiumbeingpaid,ifrequired,thisinsuranceshallremaininforceandshallterminateashereunder:(1)IftheinsuredgoodsaresoldatportorplacenotnamedinthePolicy,thisinsuranceshallterminateondeliveryofthegoodssold,butinnoeventshallthisinsuranceextendbeyondsixty(60)daysaftercompletionofdischargeoftheinsuredgoodsfromthecarryingvesselatsuchportorplace.(2)Ifth
