Issue1351Standard4.1.1STANDARD4.1.1PRIMARYPRODUCTIONANDPROCESSINGSTANDARDS–PRELIMINARYPROVISIONS(Australiaonly)PurposeandcommentaryThisStandardsetsoutpreliminaryprovisionswhichapplytothePrimaryProductionandProcessingStandardscontainedinChapter4oftheCode.TableofProvisionsDivision1–Preliminary1Interpretation2Application3WhenananimalorfoodisunacceptableDivision2–Generalfoodsafetymanagementrequirements4Thegeneralfoodsafetymanagementrequirements5FoodsafetymanagementstatementsDivision1–Preliminary1InterpretationUnlessthecontraryintentionappears,inthisChapter–AuthoritymeanstheState,TerritoryorCommonwealthagencyoragencieshavingthelegalauthoritytoimplementandenforceprimaryproductionandprocessingStandards.controlmeasuremeansameasurethatprevents,eliminatesorreducestoanacceptablelevel,afoodsafetyhazard.foodsafetymanagementstatementhasthemeaninggivenbyclause5ofthisStandard.generalfoodsafetymanagementrequirementsmeanstherequirementsinDivision2ofthisStandard.handlingoffoodincludestheproducing(includinggrowing,cultivation,picking,harvestingorcatching),collecting,extracting,processing,manufacturing,storing,transporting,delivering,preparing,treating,preserving,packing,cooking,thawing,servingordisplayingoffood.hazardmeansabiological,chemicalorphysicalagentin,orconditionof,foodthathasthepotentialtocauseanadversehealtheffectinhumans.inputsincludesanyfeed,litter,water(includingrecycledwater),chemicalsorothersubstancesusedin,orinconnectionwith,theprimaryproductionorprocessingactivity.supplyincludesintracompanytransferofproduce.verificationmeanstheapplicationofmethods,procedures,testsandothertoolsforevaluationtodeterminecompliancewiththerelevantrequirement.FederalRegisterofLegislativeInstrumentsF2012C00777Issue1352Standard4.1.12Application(1)Unlessthecontraryintentionappears,thisStandardappliestoPrimaryProductionandProcessingStandardsinChapter4ofthisCode.(2)StandardsinChapter4ofthisCodedonotapplyinNewZealand.3Whenananimalorfoodisunacceptable(1)Ananimalisunacceptableif–(a)foodderivedfromthatanimalwouldbeunsafe;(b)foodderivedfromthatanimalwouldbeunsuitable;or(c)theanimalisinaconditionwhichareasonablepersonwouldregardasmakingfoodderivedfromthatanimalunfitforhumanconsumption.(2)Afoodisunacceptableif–(a)itisunsafe;(b)itisunsuitable;or(c)itisinacondition,orcontainsasubstanceororganism,whichareasonablepersonwouldregardasmakingthatfoodunfitforhumanconsumption.(3)Toavoiddoubt,thestandardsinthisChapteroftheCodemayincludeothermatterswhich,forthepurposesofparticularstandards,makefoodoranimalsunacceptable.Division2–Generalfoodsafetymanagementrequirements4Thegeneralfoodsafetymanagementrequirements(1)WhereastandardinthisChapteroftheCodeprovidesthatapersonorbusinessisrequiredtocomplywiththegeneralfoodsafetymanagementrequirements,thatpersonorbusinessmust–(a)haveafoodsafetymanagementstatement;and(b)operateaccordingtoitsfoodsafetymanagementstatement.(2)Apersonorbusinessrequiredtocomplywiththefoodsafetymanagementrequirementsmustalso–(a)systematicallyexamineitsoperationstoidentifypotentialhazardsandimplementcontrolmeasurestoaddressthosehazards;and(b)haveevidencetoshowthatasystematicexaminationhasbeenundertakenandthatcontrolmeasuresforthoseidentifiedhazardshavebeenimplemented;and(c)verifytheeffectivenessofthecontrolmeasures.5FoodsafetymanagementstatementsAfoodsafetymanagementstatementisastatementwhich–(a)hasbeenapprovedorrecognisedbytheauthority;and(b)issubjecttoongoingverificationactivitiesbythebusinessorperson;and(c)ifrequiredbytheauthority,isalsosubjecttoongoingverificationactivitiesbytherelevantauthority;and(d)setsouthowtheobligationsimposedbythisChapteroftheCodearetobe,orarebeing,compliedwith.FederalRegisterofLegislativeInstrumentsF2012C00777Issue1353Standard4.1.1Editorialnote:Notethatbusinesseswithexistingapprovedfoodsafetyarrangements(forexample,HACCP-basedfoodsafetyprograms,Standard3.2.1ofthisCode,AQISapprovedarrangements)shouldbeconsideredtomeettheoutcomesofafoodsafetymanagementstatement.However,therelevantauthoritywillneedtoverifythattheexistingfoodsafetyarrangementmeetstherequirementsofthisDivision.SomeofthestandardsinthisChapteroftheCodecontaindefinitionsof‘foodsafetymanagementstatement’.ThosedefinitionswillberemovedwhenFSANZreviewsthosestandards.FederalRegisterofLegislativeInstrumentsF2012C00777Issue1354Standard4.1.1{THISPAGEINTENTIONALLYLEFTBLANK}FederalRegisterofLegislativeInstrumentsF2012C00777
