IMPORTANTLEGALNOTICE-Theinformationonthissiteissubjecttoadisclaimerandacopyrightnotice.31997L0023Directive97/23/ECoftheEuropeanParliamentandoftheCouncilof29May1997ontheapproximationofthelawsoftheMemberStatesconcerningpressureequipmentOfficialJournalL181,09/07/1997P.0001-0055DIRECTIVE97/23/ECOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof29May1997ontheapproximationofthelawsoftheMemberStatesconcerningpressureequipmentTHEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle100athereof,HavingregardtotheproposalsfromtheCommission(1),HavingregardtotheOpinionoftheEconomicandSocialCommittee(2),ActinginaccordancewiththeprocedurelaiddowninArticle189boftheTreaty(3),inthelightofthejointtextapprovedbytheConciliationCommitteeon4February1997,1.Whereastheinternalmarketisanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensured;2.Whereastherearedifferencesinthecontentandscopeofthelaws,regulationsandadministrativeprovisionsinforceintheMemberStateswithregardtothesafetyandprotectionofhealthofpersonsand,whereappropriate,domesticanimalsorproperty,wherepressureequipmentnotcoveredbypresentCommunitylegislationisconcerned;whereasthecertificationandinspectionproceduresforsuchequipmentdifferfromoneMemberStatetoanother;whereassuchdisparitiesmaywellconstitutebarrierstotradewithintheCommunity;3.Whereastheharmonizationofnationallegislationistheonlymeansofremovingthesebarrierstofreetrade;whereasthisobjectivecannotbeachievedsatisfactorilybytheindividualMemberStates;whereasthisDirectiveonlylaysdownindispensablerequirementsforthefreecirculationoftheequipmenttowhichitisapplicable;4.Whereasequipmentsubjecttoapressureofnotmorethan0,5bardoesnotposeasignificanthazardduetopressure;whereasthereshouldnotthereforebeanyobstacletoitsfreemovementwithintheCommunity;whereasthisDirectiveappliestoequipmentsubjecttoamaximumallowablepressurePSexceeding0,5bar;5.WhereasthisDirectiverelatesalsotoassembliescomposedofseveralpiecesofpressureequipmentassembledtoconstituteanintegratedandfunctionalwhole;whereastheseassembliesmayrangefromsimpleassembliessuchaspressurecookerstocomplexassembliessuchaswatertubeboilers;whereas,ifthemanufacturerofanassemblyintendsittobeplacedonthemarketandputintoserviceasanassembly-andnotintheformofitsconstituentnon-assembledelements-thatassemblymustconformtothisDirective;whereas,ontheotherPage1of47TXTG-31997L0023-bas-cen31/12/2006file://C:ped.htmhand,thisDirectivedoesnotcovertheassemblyofpressureequipmentonthesiteandundertheresponsibilityoftheuser,asinthecaseofindustrialinstallations;6.WhereasthisDirectiveharmonizesnationalprovisionsonhazardsduetopressure;whereastheotherhazardswhichthisequipmentmaypresentaccordinglymayfallwithinthescopeofotherDirectivesdealingwithsuchhazards;whereas,however,pressureequipmentmaybeincludedamongproductscoveredbyotherDirectivesbasedonArticle100aoftheTreaty;whereastheprovisionslaiddowninsomeofthoseDirectivesdealwiththehazardduetopressure;whereasthoseprovisionsareconsideredadequatetoprovideappropriateprotectionwherethehazardduetopressureassociatedwithsuchequipmentremainssmall;whereas,therefore,therearegroundsforexcludingsuchequipmentfromthescopeofthisDirective;7.Whereas,forpressureequipmentcoveredbyinternationalConventions,transportandpressurehazardsareduetobedealtwithassoonaspossiblebyforthcomingCommunityDirectivesbasedonsuchConventionsorbysupplementstoexistingDirectives;whereassuchequipmentisaccordinglyexcludedfromthescopeofthisDirective;8.Whereascertaintypesofpressureequipment,althoughsubjecttoamaximumallowablepressurePShigherthan0,5bar,donotpresentanysignificanthazardduetopressure,andthereforethefreedomofmovementofsuchequipmentintheCommunityshouldnotbehinderedifithasbeenlegallymanufacturedorplacedonthemarketinaMemberState;whereasitisnotnecessaryinordertoensurefreemovementofsuchequipmenttoincludeitinthescopeofthisDirective;whereasconsequentlyitisexpresslyexcludedfromitsscope;9.Whereasotherpressureequipmentsubjecttoamaximumallowablepressurehigherthan0,5barandpresentingasignificanthazardduetopressure,butinrespectofwhichfreemovementandanappropriatelevelofsafetyareguaranteed,isexcludedfromthescopeofthisDirective;whereassuchexclusionsshould,however,beregularlyreviewedinordertoascertainwhetheritisnecessarytotakeactionatUnionlevel;10.WhereasregulationstoremovetechnicalbarrierstotrademustfollowthenewapproachprovidedforintheCouncilResolutionof7May1985onanewapproachtotechnicalharmonizationandstandards(4),whichrequiresadefinitionoftheessentialrequirementsregardingsafetyandotherrequirementsofsocietywithoutreducingexisting,justifiedlevelsofprotectionwithintheMemberStates;whereasthatResolutionprovidesthataverylargenumberofproductsbecoveredbyasingleDirectiveinordertoavoidfrequentamendmentsandtheproliferationofDirectives;11.WhereastheexistingCommunityDirectivesontheapproximationofthelawsoftheMemberStatesrelatingtopressureequipmenthavemadepositivestepstowardsremovingbarrierstotradeinthisarea;whereasthoseDirectivescoverthat
