中图分类号:密级:UDC:本校编号:10652硕士学位论文论文题目:论服务商标的法律保护研究生姓名:郭云学号:20100301250903校内指导教师姓名:邓宏光职称:教授校外指导教师姓名:职务职称:申请学位等级:硕士学科:法学专业:知识产权论文提交日期:2013年月日论文答辩日期:2013年月日硕士学位论文论服务商标的法律保护TheLegalProtectionofServiceTrademarks作者姓名:郭云指导教师:邓宏光教授西南政法大学SouthwestUniversityofPoliticalScienceandLaw1内容摘要随着第三产业的发展,企业越来越重视服务商标,服务商标的注册量有了很大的提高,与此同时,抢注和假冒服务商标的现象也越来越普遍。目前,各国都对服务商标予以保护,我国亦不例外,《商标法》第四条第三款规定“本法有关商品商标的规定,适用于服务商标”。然而,服务商标与商品商标之间存在一些实质性差异,该规定未体现服务商标的特殊性。《商标法》对服务商标规定的笼统性,使得服务商标的保护存在许多问题,尤其体现在服务商标与商品商标、服务商标与商号之间的冲突上。本文从案例入手,引出我国服务商标制度中存在的突出问题,在分析的基础上,提出完善我国服务商标制度的建言。本文除引言外,共分为四个部分。引言部分分析了我国服务商标的现行法律规定和保护现状,通过引入两大典型案例,引出服务商标存在的最为突出的两大冲突问题,总结出导致这些问题的根源在于《商标法》的规定未体现服务商标的特殊性。第一部分分析了服务商标的特殊性。从使用客体、使用方式、适用领域三个方面研究了服务商标的独特属性,指出服务商标客体无形、无法黏贴于服务、适用于服务行业,明确了服务商标特殊性的关键地位,为解决服务商标存在的问题奠定基础。第二部分从冲突的表象、冲突的原因两个方面研究了服务商标与商品商标之间的冲突。指出了服务商标与商品商标在功能、使用、构成上有一定的相似性和重合性,《商标法》的规定抹杀了服务商标与商品商标之间的差异性,导致了服务商标与商品商标之间存在一定的模糊性,导致了冲突发生。并分析了现实中服务商标与商品商标最为普遍的冲突表象。第三部分同样从冲突的表象、冲突的原因两个方面研究服务商标与商号之间权利的冲突。指出服务商标与商号存在许多相似性、交叉性,相关法律规定模糊性,导致服务商标与商号存在冲突。并引入一些案例分析现实中存在的将他人在先注册的商标登记为自己的商号、将他人在先登记的商号注册为自己的商标的冲突现象。第四部分对完善我国服务商标提出一定的建议。为解决服务商标当前存在的最为突出两大问题,该部分重点阐述了协调服务商标与商号、商品商标关系的两个方面的建议,2明确侵权标准、突出服务商标的独特属性,进而解决冲突。并论述了服务商标行政保护、刑事保护方面的不足和完善,加强行政保护、纳入刑事保护,提供全面合理的保护。结语部分对本文的观点进行了总结。关键词:服务商标;商品商标;商号;行政保护;刑事保护1AbstractAsthedevelopmentoftheserviceindustry,enterprisespaymoreandmoreattentiontotheservicetrademark,theregistrationoftheservicetrademarkhavegreatlyincreased,atthesametime,cybersquattingandthecounterfeitingofservicetrademarkisalsobecomingmorecommon.Atpresent,servicetrademarkisprotectedinmanycountries,Chinaisnoexception.Thethirdparagraphofarticle4ofthetrademarklaw:theprovisionsmadeinthisLawconcerninggoodstrademarksshallapplytoservicemarks.However,therearesomesubstantivedifferencesbetweentheservicetrademarkandgoodstrademark,thisregulationdosenotreflecttheparticularityoftheservicetrademark.Thetrademarklawofservicetrademarkisambiguously,soservicetrademarkprotectionhasmanyproblems,especiallyreflectedtheconflictbetweenservicetrademarkandgoodstrademark,servicetrademarkandtradename.Thispaperdrawsoutsomeprominentproblemsaboutservicetrademarkinourcountrybyanalyzingsomecase,onthebasisofanalysis,proposesomereasonableconstructionaboutourservicetrademarksystem.Additiontotheintroduction,thisarticleisdividedintofourparts.Theintroductionpartanalyzestheexistinglegalprovisionsandprotectionofservicetrademark,thispartleadstotwomostoutstandingconflictaboutservicetrademarkbyintroducingtwotypicalcases,thispapersumsuptherootoftheproblemisthattheprovisionsofthetrademarklawkilledtheparticularityoftheservicetrademark.Thefirstpartanalyzestheparticularityoftheservicetrademark.Thispartresearchestheuniqueattributesoftheservicetrademarkfromthreeaspects:theuseoftheobject,usemethod,suitablefield.andpointsoutthattheobjectofservicetrademarkisintangible,thetrademarkisunabletopasteinservice,itshallbeapplicabletoserviceindustry.Itanalysisthekeypositionofservicetrademark,inordertolaythefoundationforaddressingproblemsofservicetrademark.Thesecondpartstudiestheconflictbetweentheservicetrademarkandgoodstrademarkfromtwoaspects-theappearanceandthecauseoftheconflict.Itpointsoutthattheservicetrademarkandgoodstrademarkhaveacertaindegreeofsimilarityandoverlaponthefunction,useandconstitution.Theprovisionsofthetrademarklawobscurethedifferencebetweenservicetrademarkandgoodstrademark,whichleadtoappearsomeambiguityand2theconflict.Anditanalysesthemostcommonconflictrepresentationoftheservicetrademarkandgoodstrademarkinreality.Thethirdpartalsostudiestheconflictbetweentheservicetrademarkandtradenamefromtwoaspects-theappearanceandthecauseoftheconflict.Itpointsoutthattheservicetrademarkandtradenameshavemanysimilaritiesandoverlap,andregulationsoftherelevantlawsareblurry,itleadstotheconflict.Andintroducesomecaseanalysisoftheexistinginrealitywillbepriorregisteredtrademarkregistrationconflictphenomenon:registeringother'sformerlyregisteredtrademarkascorporation'sname,registeringother'sformerlycheckedincorporation'snameascorporation'strademark.Thefourthpartputforwardsomesuggestiontoperfectourcountry'sservicetrademark.Inordertosolvethemostoutstandingproblem,thissectionfocusesoncoordinatingrelationshipoftradenames,goodstrademarkandservicetrademark.itcanclearinfringementstandard,outstandtheuniqueattributesofservicetrademark,andthensolvetheconflict.Anddiscussestheinsufficiencyandtheperfectoftheadministrativeprotectionandthecriminalprotectiononservicetrademark.itshouldbestrengththeadministrativeprotection,andputtheservicetrademarkintothecriminalprotection,toprovidecomprehensiveandreasonableprotectionforit.Theconclusionpartsummarizesthecentralideaofthearticle.Keywords:Servicetrademark;Goodstrademark;Tradename;Administrativeprotection;Criminalprotection1目录引言....................................................................................................................................1一、服务商标的特殊性............................................................................................................3(一)使用客体的独特性.....................................
