DIRECTIVE2006/12/ECOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof5April2006onwaste(TextwithEEArelevance)THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle175thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),AfterconsultingtheCommitteeoftheRegions,ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty(2),Whereas:(1)CouncilDirective75/442/EECof15July1975onwaste(3)hasbeensignificantlyamendedonseveraloccasions(4).Inordertoclarifymatters,acodificationoftheprovisionsinquestionshouldbedrawnup.(2)Theessentialobjectiveofallprovisionsrelatingtowastemanagementshouldbetheprotectionofhumanhealthandtheenvironmentagainstharmfuleffectscausedbythecollection,transport,treatment,storageandtippingofwaste.(3)CommonterminologyandadefinitionofwasteareneededinordertoimprovetheefficiencyofwastemanagementintheCommunity.(4)Effectiveandconsistentrulesonwastedisposalandrecoveryshouldbeapplied,subjecttocertainexceptions,tomovablepropertywhichtheholderdiscardsorintendsorisrequiredtodiscard.(5)Therecoveryofwasteandtheuseofrecoveredmaterialsasrawmaterialsshouldbeencouragedinordertoconservenaturalresources.Itmaybenecessarytoadoptspecificrulesforre‑usablewaste.(6)Inordertoachieveahighlevelofenvironmentalprotection,MemberStatesshould,inadditiontotakingresponsibleactiontoensurethedisposalandrecoveryofwaste,takemeasurestorestricttheproductionofwasteparticularlybypromotingcleantechnologiesandproductswhichcanberecycledandre‑used,takingintoconsiderationexistingorpotentialmarketopportunitiesforrecoveredwaste.(7)Moreover,discrepanciesbetweenMemberStates’legisla-tionwithregardtowastedisposalandrecoverymayaffectthequalityoftheenvironmentandthesmoothoperationoftheinternalmarket.(8)ItisimportantfortheCommunityasawholetobecomeself‑sufficientinwastedisposalanddesirableforMemberStatesindividuallytoaimatsuchself‑sufficiency.(9)Inordertoachievethoseobjectives,wastemanagementplansshouldbedrawnupintheMemberStates.(10)MovementsofwasteshouldbereducedandMemberStatesmaytakethenecessarymeasurestothatendintheirmanagementplans.(11)Toensureahighlevelofprotectionandeffectivecontrol,itisnecessarytoprovideforauthorisationandinspectionofundertakingswhichcarryoutwastedisposalandrecovery.27.4.2006ENOfficialJournaloftheEuropeanUnionL114/9(1)OJC112,30.4.2004,p.46.(2)OpinionoftheEuropeanParliamentof9March2004(OJC102E,28.4.2004,p.106)andCouncilDecisionof30January2006.(3)OJL194,25.7.1975,p.39.DirectiveaslastamendedbyRegulation(EC)No1882/2003oftheEuropeanParliamentandoftheCouncil(OJL284,31.10.2003,p.1).(4)SeePartAofAnnexIII.(12)Subjecttocertainconditions,andprovidedthattheycomplywithenvironmentalprotectionrequirements,someestablishmentswhichprocesstheirwastethem-selvesorcarryoutwasterecoverymaybeexemptedfrompermitrequirements.Suchestablishmentsshouldbesubjecttoregistration.(13)Inorderthatwastecanbemonitoredfromitsproductiontoitsfinaldisposal,otherundertakingsinvolvedwithwaste,suchaswastecollectors,carriersandbrokersshouldalsobesubjecttoauthorisationorregistrationandappropriateinspection.(14)Thatproportionofthecostsnotcoveredbytheproceedsoftreatingthewastemustbedefrayedinaccordancewiththe‘polluterpays’principle.(15)ThemeasuresnecessaryfortheimplementationofthisDirectiveshouldbeadoptedinaccordancewithCouncilDecision1999/468/ECof28June1999layingdowntheproceduresfortheexerciseofimplementingpowersconferredontheCommission(1).(16)ThisDirectiveshouldbewithoutprejudicetotheobligationsoftheMemberStatesrelatingtothetime-limitsfortranspositionintonationallawoftheDirectiveslistedinPartBofAnnexIII,HAVEADOPTEDTHISDIRECTIVE:Article11.ForthepurposesofthisDirective:(a)‘waste’shallmeananysubstanceorobjectinthecategoriessetoutinAnnexIwhichtheholderdiscardsorintendsorisrequiredtodiscard;(b)‘producer’shallmeananyonewhoseactivitiesproducewaste(‘originalproducer’)and/oranyonewhocarriesoutpre‑processing,mixingorotheroperationsresultinginachangeinthenatureorcompositionofthiswaste;(c)‘holder’shallmeantheproducerofthewasteorthenaturalorlegalpersonwhoisinpossessionofit;(d)‘management’shallmeanthecollection,transport,recoveryanddisposalofwaste,includingthesupervisionofsuchoperationsandafter‑careofdisposalsites;(e)‘disposal’shallmeananyoftheoperationsprovidedforinAnnexIIA;(f)‘recovery’shallmeananyoftheoperationsprovidedforinAnnexIIB;(g)‘collection’shallmeanthegathering,sortingand/ormixingofwasteforthepurposeoftransport.2.Forthepurposesofparagraph1,point(a),theCommission,actinginaccordancewiththeprocedurereferredtoinArticle18(3),shalldrawupalistofwastebelongingtothecategorieslistedinAnnexI.Thislistshallbeperiodicallyreviewedand,ifnecessary,revisedinaccordancewiththesameprocedure.Article21.ThefollowingshallbeexcludedfromthescopeofthisDirective:(a)gaseouseffluentsemittedintotheatmosphere;(b)wheretheyarealreadycoveredbyotherlegislation:(i)radioactivewaste;(ii)wasteresultingfromprospecting,extraction,treat-mentandstorageofmineralresourcesandtheworkingofquarries;(i
