ICAS英格尔上海中山西路2368号华鼎大厦801室200235认证合同书Tel:[phone]Fax:[phone]AP0312Ipage1of3认证合同书CertificationContract合同编号：ContractNumber：一、总则一、GeneralProvisions（以下简称甲方），委托上海英格尔认证有限公司（以下简称乙方），为甲方提供认证服务。甲乙双方依照《中华人民共和国合同法》等法律法规、行业主管部门的规定，经平等协商，本着“客观、公正、独立、诚信”的原则，在理解和同意以下条款的基础上签订本合同，并承诺共同遵守。(TheundersignedreferredtoasPartyA),commissionedShanghaiIngeerCertificationLtd(TheundersignedreferredtoasPartyB)toofferCertificationforPartyA.BothPartyAandPartyBinaccordancewithThePeople'sRepublicofChinaContractLawandotherlawsandregulations、theprovisionsoftheindustrydepartmentandafteranequalfootinginaccordancewiththespiritofobjectivity、impartiality、independence、goodfaithprinciple,understandandagreetothefollowingtermstosignthiscontractandpromisedtoabideby.二、甲方权利和义务二、TherightsandObligationsofPartyA１．甲方有权宣传获准认证的事实，享有由于获准认证以及使用认证标志取得的经济利益。1.PartyAhastherightstopublicizethatcertificationispermissibletoenjoyasauthenticationandtheuseofcertificationmarkstoobtaineconomicinterests.２．甲方如果与乙方在认证过程中产生的争议，甲方有权向乙方提出申投诉，乙方应按照申投诉程序解决争议。2.IfPartyAandPartyBhavedisputesinthecertificationprocess,PartyAisentitledtoraisecomplaintstoPartyBofwhichPartyBshallthensettlethedisputesinaccordancewiththecomplaintprocedure.３．甲方应根据认证程序积极配合乙方的审核，向乙方提供真实充分的信息和记录。否则应承担信息不准确或不真实所造成的一切后果。3.PartyA,inaccordancewithcertificationprogramshallactivelycooperatewiththeauditofPartyBtoproviderealandadequateinformationandrecordsforPartyB.Otherwise,alltheconsequencescausedbyinaccurateorfalseinformationshallbeaccepted.４．甲方向乙方提出认证申请时，应明确告知乙方前六个月内，是否向其他认证机构提交过同样的认证申请但未被授理或审核未通过、已经获得其他机构的认证证书但目前被暂停、撤销、注销等信息。4.WhenPartyAappliesforcertificationtoPartyB,PartyAshouldinformPartyBifthefollowingoccurwithinthelastsixmonths:1.whetherornotPartAhassubmittedanapplicationtosomeothercertificationbodiesoritfailstopasscertification.2.PartyAhasalreadyacquiredthecertificatefromothercertificationbodiesbutthecertificateissuspended,terminatedorcancelled.5.甲方获证后，应确保认证所覆盖的管理体系持续有效运行，并按期接受乙方的监督审核及再认证审核，以便乙方验证认证所覆盖的管理体系是否持续符合认证要求，ICAS英格尔上海中山西路2368号华鼎大厦801室200235认证合同书Tel:[phone]Fax:[phone]AP0312Ipage2of35.PartyA,aftercertified,shouldensurethatthecertificationofmanagementsystemsrunningshallcontinuetobeenforceandacceptthesurveillanceandcertificationauditsoPartyBcanverifythecertificationofmanagementsystemshasbeenpersistentlyenforcedincompliancewiththecertificationrequirements.初评获证后，在证书有效期内，须按期接受三次监督审核，第一次监督审核在初评审核后第6个月进行，以后每次监督审核间隔9-12个月。Preliminaryassessmentofcertificationatthecertificatevalidityperiodhasthreesurveillanceassessments;forthefirsttimesurveillanceassessmentsinevaluationreviewis6months,eachsubsequentsurveillanceassessmentsintervalis9-12months.再认证获证后，在证书有效期内，须按期接受两次监督审核，第一次监督审核在再认证审核后第10个月进行，以后每次监督审核间隔9-12个月。Afterre-certification,thecertificateisabstained.Thesecondsupervisoryreviewisscheduledwithinthecertificate’svalidityperiod.Supervisionandexaminationforthefirsttimeafterthefirst10monthsforre-certificationauditandsupervisionandexaminationistobeconductedafterthetimeintervalsof9-12months.再认证应在证书到期前三个月实施。Re-certificationshouldbeimplementedthreemonthsbeforethecertificateexpires５．甲方应按照双方约定的时间和数额向乙方交纳相关认证费。6.PartyAinaccordancewiththetimingandamountagreeduponbythetwosidestothePartyshallpayfeesrelatedtoaccreditation.６．甲方获证后，在证书有效期内，如发生重大顾客投诉、重大质量、生产、环境、安全事故，或发生以下重大变化，应及时书面通报乙方。7.AfterPartyAabstainthecertificatewithinthevalidityperiodofthecertificate,majorcustomercomplaints,significantquality,production,environment,safetyincidents,orduringthefollowingmajorchangesshouldbepromptlynotifiedtoPartyB法律地位、经营状况、组织状态或所有权；legalstatus,operatingconditions,organizationalstatusorownership组织或管理层（如关键的管理、决策、或技术人员）；organizationormanagement(suchaskeymanagement,decision-making,ortechnicalstaff)联系地址和场所；contactaddressesandplaces获证管理体系覆盖的认证范围；certifiedmanagementsystemcoveringthescopeofcertification管理和过程的重大变更；majorchangesofmanagementandprocess乙方决定暂停或撤消证书时，甲方应立即停止使用认证证书、认证标志及其复印件。WhenPartyBdecidestosuspendorrevokethecertificate,PartyAshouldimmediatelystopusingthecertificate,thecertificationlogoandthecopyofthecertificate.甲方获证后，应根据《认证认可标徽标志及证书的使用规则》正确使用认证证书和认证标志。AfterPartyAobtainscertificate,authenticationcertificatesandcertificationmark,itshouldbeproperlyICAS英格尔上海中山西路2368号华鼎大厦801室200235认证合同书Tel:[phone]Fax:[phone]AP0312Ipage3of3useundertheCertificationandAccreditationstandardlogosignsandrulesregardinguseofthecertificate.8.甲方如决定注销证书，应书面通知乙方，办理证书注销手续，并将证书交还乙方。8.IfPartyAdecidestocancelthecertificate,PartyAshouldnotifyPartyBandPartyBwillhandlethecancellationproceduresandthecertificateisreturnbacktoPartyB.9.证书被注销、暂停或撤消后，甲方不得继续在任何业务活动中使用被注销的认证证书和认证标志，并销毁所有带有被注销的认证证书和标志的所有产品包装、宣传材料、广告、名片、公函等。9.Afterthecertificateiscancelled,suspendedorwithdrawn,PartyAcannotcontinuetousethecertificationinanybusinessactivitiesusingwrittenoffcertificatesandcertificationmarks.PartyAcannotdestroyproductpackaging,promotionalmaterials,advertising,businesscards,letters,etc.forallwrittenoffcertificatesandlogoallproductpackaging,promotionalmaterials,advertising,businesscards,letters,etc.三、乙方的权利和义务三、TherightsandobligationsofPartyB
