1房屋租赁合同TenancyAgreement2房屋租赁合同TenancyAgreement一.出租人:(以下简称“甲方”)Landlord:(hereinafterreferredtoasPartyA)代表人二.承租人:(以下简称“乙方)Tenant:(hereinafterreferredtoasPartyB)三.租赁范围及用途:Tenancy:甲方同意将其所有的位于中国上海市室房屋及其设施(包括附件一所列家具和电器)在良好及可租赁的状态下租给乙方居住使用,租赁房屋的面积总计约平方米。PartyAherebyagreestoleaseitspropertylocatedatUnit,Shanghai,PRC,andtherelatedfacilities(includingfurnitureandappliances)ingoodandtenantableconditiontoPartyBforresidentialuse.Thesizeoftheleasedpropertyisapproximatelym2.乙方指定物业使用者为。ThesaidOccupantisn.四、租赁期:TermofTenancy:4.1租赁期为年,自年月日至年月日。Theabovepropertyisherebyleasedforatermof1year(s),commencingonandexpiringon.4.2租赁期满,甲方有权收回全部租赁房屋,乙方应如期交还。乙方如要求续租,须在本合同期满日前二个月向甲方提出书面申请,除了双方衷诚地协议续租的年期及租金外,双方将按于本合约相同的条款另行签订续租合同。Onexpiryofthetenancy,PartyAhastherighttotakebacktheentireleasedproperty,andPartyBshalldelivertheleasedpropertytoPartyA.IfPartyBasksforrenewingthelease,PartyBshallgivePartyA2months’writtenapplicationinadvancebeforetheexpirationdate,andgettherenewalagreement3signedbybothpartiesonthesametermsandconditionsasthisAgreementsaveandexceptthatthePartiesshallnegotiateandagreeuponingoodfaith,therenewaltermsandmonthlyrental.4.3在租赁期满十个月后,乙方可以提前二个月书面通知甲方终止此合同,并同意甲方在此期间安排潜在客户参观该物业。Afterthetenthmonthofthetenancy,theTenantmayterminatethissaidAgreementbygivingtheLandlordtwo(2)calendarmonthsnoticeinwriting,andagreethelandlordtoshowtheapartmenttopotentialtenant.在乙方付清本合同项下规定其应该支付的费用后十五个工作日内全额无息将二个月保证金如数归还乙方。如乙方在已经办理了退房手续支付所有的费用后十五个工作日内未收到甲方归还的全额押金,则视为逾期未归还押金,每逾期一天超出归还日期后未支付,乙方须按日加付租金3%的滞纳金。Thetwomonths’depositshallbereturnedtoPartyBinfullwithin15workingdaysafterthecheck-outprocedurehasbeenhandled.IfPartyBdidnotreceivethefullamountofdepositafterPartyBhasalreadypaidalltherelevantexpenseswithin15workingdays,PartyAshouldbeliabletopayapenaltyfeeequalto3%oftherentperday.五、租金:Rent:5.1双方议定租金为每月人民币圆整包括物业管理费,发票税金,有线电视和卫星电视安装和使用费,电话及宽带的安装费用。TherentagreedtobybothpartiesduringtheleasetermisRMBpermonthinclusiveofmanagementfee,invoicetax,cableTVandsatelliteTVinstallation&usagefee,telephoneinstallation,broadbandinstallationfee.5.2乙方应提前支付甲方每月的租金,应在每月的第天或以前汇至甲方指定的银行帐号,支付租金日期以乙方汇出日期为准。乙方应以人民币形式支付租金。甲方需提供租金的付款通知单予乙方。PartyBhereundershallpayeachmonth’srentinadvance,onorbeforethedayofeachcalendarmonth,bytransferringtheamountofsuchrenttoabankaccountdesignatedbyPartyA.Thedateoftransfershallbethedateofpayment.PartyAshallprovidedebitnoteonrental.乙方须于年月日或在此之前,支付从年月日起至年月日(包括首尾两日)的首期租金人民币4Onorbefore,PartyBshallpaytoPartyAtherentalfortheperiodfromto(inclusive),intheamountofRMB.5.3如租金逾期支付,每逾期一天超出付款日期后七天仍未支付,乙方须按日加付租金3%的滞纳金。如超过15天未付则视为乙方自动退租,构成违约,甲方有权收回出租房屋,并追究乙方违约责任。Iftherentshallbeunpaidforseven(7)daysaftertherentshallbecomedueandpayable,PartyBshallbeliabletopayalatepenaltyfeeequalto3%oftherentperday.Iftherenthasnotbeenpaidmorethan15daysaftertheduedate,PartyBwillbedeemedtohaveautomaticallyterminatedthetenancyresultinginabreachofthisAgreement.PartyAwillthenbeentitledtotakebacktheleasedpropertyandhaverecourseagainstPartyBforbreachofcontract.六、保证金:SecurityDeposit:6.1为确保租赁房屋及其设施之安全与完好及租赁期内相关费用之如期结算,乙方应在甲方提供该租赁房屋的产权证复印件(或预售/预租许可证)支付给甲方二个月租金额及管理费的租赁保证金计人民币圆整,做为乙方确保合同履行之保证金,保证金的支付日不得晚于起租日。乙方可以人民币形式支付保证金。甲方应在收到保证金的七个工作日内提供相应的正式收据给乙方。Toensurethewelfareandgoodconditionoftheleasedpropertyaswellasthepromptpaymentandsettlementofallrelatedchargesduringthetermofthetenancy,PartyBagreestopayPartyAsecuritydepositequaltotwomonths’rentandmanagementfeeintheamountofRMBassecurityforPartyB’shereunderoncethecopyofownershipcertificate(orpre-sell/pre-leasepermit)ofthepremisesisprovided.PartyAshallprovidetheformalreceipttoPartyBwithin7workingdaysafterreceivingthedeposit.6.2除合同另有约定之外,甲方应于租赁期满或此合同提前终止之日且双方确认该租赁房屋的归还和乙方付清所有相关费用后的十五个工作日内将保证金全额无息退还乙方。UnlessotherwiseprovidedinthisAgreement,PartyAshallreturntoPartyBtheentiresecuritydepositwithoutinterestin15workingdaysafterexpirationofthetenancyorearlydeterminationofthisAgreementandbothpartieshave5confirmedthereturnofthepremisesandPartyBhaspaidallrelatedoutstandingfees.6.3甲方因乙方违反本合同的规定而受的损失,可在保证金中扣抵合理数目,不足部分乙方必须在接到甲方付款通知后十天内补足。PartyAmaydeductareasonableamountofsecuritydeposittowardspaymentofanyactualdamagesPartyAshallhaveincurredorsufferedasaresultofPartyB’sbreachofthisAgreement.Ifthesecuritydepositisnotsufficienttocoversuchamounts,PartyBmustpaythedeficiencywithin10daysofthereceiptofademandfromPartyA.七、其他费用:OtherCharges:乙方应承担租赁期内的水、电、煤气、电话费、宽带月租费等,并按上海市公共事业局的帐单如期缴纳。PartyBisresponsibleforpayingwater,gas,electricity,telephonechargesandbroadbandmonthlyfee.SuchchargesshallbepaidwhendueaccordingtothebillsfromShanghaiUtilityBureauthereforreceivedbyPartyB.八、出租人的责任:Landlord’sObligations:8.1甲方须按时将租赁房屋以良好可租赁状态交付乙方使用。办理交房手续前,甲,乙双方必须清查该物业及其内部所有设施的运行情况。如有任何设施无法正常运作,则应被视为未能按时交房,直至视察时所有设施及设备均呈正常运作状况。在此情况下,双方应签署一份视察情况记录一式两份并且作为本合同的一部分以示房屋交接完毕。PartyAshalldeliveronscheduletoPartyBtheleasedpropertyingoodandtenantableconditionforPartyB’suse.Priortohandoverbothpartiesshallparticipateinawalkthroughinspectionofthepremisestoinventoryallfacilitiesthereinandensuretheirproperworkingcondition.Shouldanyofthefacilitiesorfixturesnotbeinworkingorderthehandoverwillbedeemedincomplete
