STATUTEOFTHESPECIALCOURTFORSIERRALEONEHavingbeenestablishedbyanAgreementbetweentheUnitedNationsandtheGovernmentofSierraLeonepursuanttoSecurityCouncilresolution1315(2000)of14August2000,theSpecialCourtforSierraLeone(hereinaftertheSpecialCourt)shallfunctioninaccordancewiththeprovisionsofthepresentStatute.Article1CompetenceoftheSpecialCourt1.TheSpecialCourtshall,exceptasprovidedinsubparagraph(2),havethepowertoprosecutepersonswhobearthegreatestresponsibilityforseriousviolationsofinternationalhumanitarianlawandSierraLeoneanlawcommittedintheterritoryofSierraLeonesince30November1996,includingthoseleaderswho,incommittingsuchcrimes,havethreatenedtheestablishmentofandimplementationofthepeaceprocessinSierraLeone.2.AnytransgressionsbypeacekeepersandrelatedpersonnelpresentinSierraLeonepursuanttotheStatusofMissionAgreementinforcebetweentheUnitedNationsandtheGovernmentofSierraLeoneoragreementsbetweenSierraLeoneandotherGovernmentsorregionalorganizations,or,intheabsenceofsuchagreement,providedthatthepeacekeepingoperationswereundertakenwiththeconsentoftheGovernmentofSierraLeone,shallbewithintheprimaryjurisdictionofthesendingState.3.IntheeventthesendingStateisunwillingorunablegenuinelytocarryoutaninvestigationorprosecution,theCourtmay,ifauthorizedbytheSecurityCouncilontheproposalofanyState,exercisejurisdictionoversuchpersons.Article2CrimesagainsthumanityTheSpecialCourtshallhavethepowertoprosecutepersonswhocommittedthefollowingcrimesaspartofawidespreadorsystematicattackagainstanycivilianpopulation:a.Murder;b.Extermination;c.Enslavement;d.Deportation;e.Imprisonment;f.Torture;g.Rape,sexualslavery,enforcedprostitution,forcedpregnancyandanyotherformofsexualviolence;h.Persecutiononpolitical,racial,ethnicorreligiousgrounds;i.Otherinhumaneacts.Article3ViolationsofArticle3commontotheGenevaConventionsandofAdditionalProtocolIITheSpecialCourtshallhavethepowertoprosecutepersonswhocommittedororderedthecommissionofseriousviolationsofarticle3commontotheGenevaConventionsof12August1949fortheProtectionofWarVictims,andofAdditionalProtocolIItheretoof8June1977.Theseviolationsshallinclude:a.Violencetolife,healthandphysicalormentalwell-beingofpersons,inparticularmurderaswellascrueltreatmentsuchastorture,mutilationoranyformofcorporalpunishment;b.Collectivepunishments;c.Takingofhostages;d.Actsofterrorism;e.Outragesuponpersonaldignity,inparticularhumiliatinganddegradingtreatment,rape,enforcedprostitutionandanyformofindecentassault;f.Pillage;g.Thepassingofsentencesandthecarryingoutofexecutionswithoutpreviousjudgementpronouncedbyaregularlyconstitutedcourt,affordingallthejudicialguaranteeswhicharerecognizedasindispensablebycivilizedpeoples;h.Threatstocommitanyoftheforegoingacts.Article4OtherseriousviolationsofinternationalhumanitarianlawTheSpecialCourtshallhavethepowertoprosecutepersonswhocommittedthefollowingseriousviolationsofinternationalhumanitarianlaw:a.Intentionallydirectingattacksagainstthecivilianpopulationassuchoragainstindividualciviliansnottakingdirectpartinhostilities;b.Intentionallydirectingattacksagainstpersonnel,installations,material,unitsorvehiclesinvolvedinahumanitarianassistanceorpeacekeepingmissioninaccordancewiththeCharteroftheUnitedNations,aslongastheyareentitledtotheprotectiongiventociviliansorcivilianobjectsundertheinternationallawofarmedconflict;c.Conscriptingorenlistingchildrenundertheageof15yearsintoarmedforcesorgroupsorusingthemtoparticipateactivelyinhostilities.Article5CrimesunderSierraLeoneanlawTheSpecialCourtshallhavethepowertoprosecutepersonswhohavecommittedthefollowingcrimesunderSierraLeoneanlaw:a.OffencesrelatingtotheabuseofgirlsunderthePreventionofCrueltytoChildrenAct,1926(Cap.31):i.Abusingagirlunder13yearsofage,contrarytosection6;ii.Abusingagirlbetween13and14yearsofage,contrarytosection7;iii.Abductionofagirlforimmoralpurposes,contrarytosection12.b.OffencesrelatingtothewantondestructionofpropertyundertheMaliciousDamageAct,1861:i.Settingfiretodwelling-houses,anypersonbeingtherein,contrarytosection2;ii.Settingfiretopublicbuildings,contrarytosections5and6;iii.Settingfiretootherbuildings,contrarytosection6.Article6Individualcriminalresponsibility1.Apersonwhoplanned,instigated,ordered,committedorotherwiseaidedandabettedintheplanning,preparationorexecutionofacrimereferredtoinarticles2to4ofthepresentStatuteshallbeindividuallyresponsibleforthecrime.2.Theofficialpositionofanyaccusedpersons,whetherasHeadofStateorGovernmentorasaresponsiblegovernmentofficial,shallnotrelievesuchpersonofcriminalresponsibilitynormitigatepunishment.3.Thefactthatanyoftheactsreferredtoinarticles2to4ofthepresentStatutewascommittedbyasubordinatedoesnotrelievehisorhersuperiorofcriminalresponsibilityifheorshekneworhadreasontoknowthatthesubordinatewasabouttocommitsuchactsorhaddonesoandthesuperiorhadfailedtotakethenecessaryandreasonablemeasurestopreventsuchactsortopunishtheperpetratorsthereof.4.ThefactthatanaccusedpersonactedpursuanttoanorderofaGovernmentorofasuperiorshallnotrelievehimorherofcriminalresponsibility,butmaybeconsideredinmitigationofpunishmentiftheS
