CorrigendumtoRegulation(EC)No850/2004oftheEuropeanParliamentandoftheCouncilof29April2004onpersistentorganicpollutantsandamendingDirective79/117/EEC(OfficialJournaloftheEuropeanUnionL158of30April2004)Regulation(EC)No850/2004shouldreadasfollows:REGULATION(EC)No850/2004OFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof29April2004onpersistentorganicpollutantsandamendingDirective79/117/EECTHEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCom-munity,andinparticularArticle175(1)thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),AfterconsultingtheCommitteeoftheRegions,ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty(2),Whereas:(1)ThisRegulationprimarilyconcernsenvironmentalprotectionandtheprotectionofhumanhealth.ThelegalbasisisthereforeArticle175(1)oftheTreaty.(2)TheCommunityisseriouslyconcernedbythecontin-uousreleaseofpersistentorganicpollutantsintotheenvironment.Thesechemicalsubstancesaretransportedacrossinternationalboundariesfarfromtheirsourcesandtheypersistintheenvironment,bioaccumulatethroughthefoodweb,andposearisktohumanhealthandtheenvironment.Furthermeasuresneedthereforetobetakeninordertoprotecthumanhealthandtheenvironmentagainstthesepollutants.(3)Inviewofitsresponsibilitiesfortheprotectionoftheenvironment,theCommunitysignedon24June1998theProtocoltothe1979ConventiononLong-RangeTransboundaryAirPollutiononPersistentOrganicPollu-tants,hereinafter‘theProtocol’,andon22May2001theStockholmConventiononPersistentOrganicPollutants,hereinafter‘theConvention’.(4)WhilelegislationatCommunitylevelrelatingtopersis-tentorganicpollutantshasbeenputinplace,itsmaindeficienciesarethatthereisanabsenceof,orincompletelegislationon,prohibitionoftheproductionanduseofanyofthecurrentlylistedchemicals,thatthereisnoframeworktosubjectadditionalpersistentorganicpollu-tantsubstancestoprohibitions,restrictionsorelimina-tion,noranyframeworktopreventtheproductionanduseofnewsubstancesthatexhibitpersistentorganicpollutantcharacteristics.Noemissionreductiontargets,assuch,havebeensetatCommunitylevelandthecurrentreleaseinventoriesdonotcoverallsourcesofpersistentorganicpollutants.(5)InordertoensurecoherentandeffectiveimplementationoftheCommunity'sobligationsundertheProtocolandtheConvention,itisnecessarytoestablishacommonlegalframework,withinwhichtotakemeasuresdesignedinparticulartoeliminatetheproduction,placingonthemarketanduseofintentionallyproducedpersistentorganicpollutants.Furthermore,persistentorganicpollutants'characteristicsshouldbetakenintoconsiderationintheframeworkoftherelevantCom-munityassessmentandauthorisationschemes.(6)CoordinationandcoherenceshouldbeensuredwhenimplementingatCommunityleveltheprovisionsoftheRotterdam(3),StockholmandBaselConventions(4)andwhenparticipatinginthedevelopmentoftheStrategicApproachtoInternationalChemicalsManagement(SAICM)withintheUnitedNationsframework.29.6.2004L229/5OfficialJournaloftheEuropeanUnionEN(1)OJC32,5.2.2004,p.45.(2)OpinionoftheEuropeanParliamentof26February2004(notyetpublishedintheOfficialJournal)andDecisionoftheCouncilof26April2004.(3)Conventiononthepriorinformedconsentprocedureforcertainhazardouschemicalsandpesticidesininternationaltrade.(4)Conventiononthecontroloftransboundarymovementsofhazar-douswastesandtheirdisposal.(7)Moreover,consideringthattheprovisionsofthisRegu-lationareunderpinnedbytheprecautionaryprincipleassetforthintheTreaty,andmindfulofPrinciple15oftheRioDeclarationonEnvironmentandDevelopmentandinviewoftheaimofelimination,wherefeasible,ofthereleaseofpersistentorganicpollutantsintotheenvir-onment,itisappropriateincertaincasestoprovideforcontrolmeasuresstricterthanthoseundertheProtocolandtheConvention.(8)Inthefuture,theproposedREACHRegulationcouldbeanappropriateinstrumentbywhichtoimplementthenecessarycontrolmeasuresonproduction,placingonthemarketanduseofthelistedsubstancesandthecontrolmeasuresonexistingandnewchemicalsandpesticidesexhibitingpersistentorganicpollutants'char-acteristics.However,withoutprejudicetothefutureREACHRegulationandsinceitisimportanttoimple-mentthesecontrolmeasuresonthelistedsubstancesoftheProtocolandtheConventionassoonaspossible,thisRegulationshouldfornowimplementthosemeasures.(9)IntheCommunity,theplacingonthemarketanduseofmostofthepersistentorganicpollutantslistedintheProtocolortheConventionhasalreadybeenphasedoutasaresultoftheprohibitionslaiddowninCouncilDirective79/117/EECof21December1978prohibitingtheplacingonthemarketanduseofplantprotectionproductscontainingcertainactivesubstances(1)andCouncilDirective76/769/EECof27July1976ontheapproximationofthelaws,regulationsandadministra-tiveprovisionsoftheMemberStatesrelatingtorestric-tionsonthemarketinganduseofcertaindangeroussubstancesandpreparations(2).However,inordertofulfiltheCommunity'sobligationsundertheProtocolandtheConventionandtominimisethereleaseofpersistentorganicpollutants,itisnecessaryandappro-priatealsotoprohibittheproductionofthosesubstancesandtorestrictexemptionstoaminimumsothatexem
