中华人民共和国劳动法(英文版)LabourAct.Dated5July1994.(ChinaDaily,6July1994,p.2.)TableofcontentsCHAPTERI.GENERALPROVISIONSCHAPTERII.PROMOTIONOFEMPLOYMENTCHAPTERIII.LABOURCONTRACTSANDCOLLECTIVECONTRACTSCHAPTERIV.WORKINGHOURS,RESTANDVACATIONSCHAPTERV.WAGESCHAPTERVI.OCCUPATIONALSAFETYANDHEALTHCHAPTERVII.SPECIALPROTECTIONFORFEMALESTAFFANDJUVENILEWORKERSCHAPTERVIII.VOCATIONALTRAININGCHAPTERIX.SOCIALINSURANCEANDWELFARECHAPTERX.LABOURDISPUTESCHAPTERXI.SUPERVISIONANDINSPECTIONCHAPTERXII.LEGALRESPONSIBILITYCHAPTERXIII.SUPPLEMENTARYPROVISIONSCHAPTERI.GENERALPROVISIONSSection1.ThisLawisformulatedinaccordancewiththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflabourers,readjustlabourrelationship,establishandsafeguardalaboursystemsuitedtothesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.Section2.ThisLawappliestoallenterprisesandindividualeconomicorganizations(hereafterreferredtoasemployingunits)withintheboundaryofthePeople'sRepublicofChina,andlabourerswhoformalabourrelationshiptherewith.Stateorgans,institutionalorganizationsandsocietiesaswellaslabourerswhoformalabourcontractrelationshiptherewithshallfollowthisLaw.Section3.Labourersshallhavetherighttobeemployedonanequalbasis,chooseoccupations,obtainremunerationfortheirlabour,takerest,haveholidaysandleaves,obtainprotectionofoccupationalsafetyandhealth,receivetraininginvocationalskills,enjoysocialinsuranceandwelfare,andsubmitapplicationsforsettlementoflabourdisputes,andotherrightsrelatingtolabourasstipulatedbylaw.Labourersshallfulfiltheirlabourtasks,improvetheirvocationalskills,followrulesonoccupationalsafetyandhealth,andobservelabourdisciplineandprofessionalethics.Section4.Theemployingunitsshallestablishandperfectrulesandregulationsinaccordancewiththelawsoastoensurethatlabourersenjoytherighttoworkandfulfillabourobligations.Section5.TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,laydownlabourstandards,regulatesocialincomes,perfectsocialinsurancesystem,coordinatelabourrelationship,andgraduallyraisethelivingstandardoflabourers.Section6.TheStateshalladvocatetheparticipationoflabourersinsocialvoluntarylabourandthedevelopmentoftheirlabourcompetitionsandactivitiesofforwardingrationalproposals,encourageandprotectthescientificresearchandtechnicalrenovationengagedbylabourers,aswellastheirinventionsandcreations;andcommendandawardlabourmodelsandadvancedworkers.Section7.Labourersshallhavetherighttoparticipateinandorganizetradeunionsinaccordancewiththelaw.TradeUnionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflabourers,andindependentlyconducttheiractivitiesinaccordancewiththelaw.Section8.Labourersshall,throughtheassemblyofstaffandworkersortheircongress,orotherformsinaccordancewiththeprovisionsoflaws,rulesandregulations,takepartindemocraticmanagementorconsultwiththeemployingunitsonanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflabourers.Section9.ThelabouradministrativedepartmentoftheStateCouncilshallbeinchargeofthemanagementoflabourofthewholecountry.Thelabouradministrativedepartmentsofthelocalpeople'sgovernmentsatorabovethecountylevelshallbeinchargeofthemanagementoflabourintheadministrativeareasundertheirrespectivejurisdiction.CHAPTERII.PROMOTIONOFEMPLOYMENTSection10.TheStateshallcreateconditionsforemploymentandincreaseopportunitiesforemploymentbymeansofthepromotionofeconomicandsocialdevelopment.TheStateshallencourageenterprises,institutionalorganizations,andsocietiestoinitiateindustriesorexpandbusinessesfortheincreaseofemploymentwithinthescopeofthestipulationoflaws,andadministrativerulesandregulations.TheStateshallsupportlabourerstogetjobsbyorganizingthemselvesonavoluntarybasisorbyengaginginindividualbusinesses.Section11.Localpeople'sgovernmentsinvariouslevelsshalltakemeasurestodevelopvariouskindsofjob-introductionagenciesandprovideemploymentservices.Section12.Labourersshallnotbediscriminatedagainstinemployment,regardlessoftheirethniccommunity,race,sex,orreligiousbelief.Section13.Femalesshallenjoyequalrightsasmalesinemployment.Itshallnotbeallowed,intherecruitmentofstaffandworkers,tousesexasaprotextforexcludingfemalesfromemploymentortoraiserecruitmentstandardsforthefemales,exceptforthetypesofworkorpoststhatarenotsuitableforfemalesasstipulatedbytheState.Section14.Wheretherearespecialstipulationsinlaws,rulesandregulationsontheemploymentofthedisabled,thepersonnelofnationalminorities,anddemobilizedarmymen,suchspecialstipulationsshallapply.Section15.Noemployingunitsshallbeallowedtorecruitjuvenilesundertheageof16.Unitsofliteratureandart,physicalcultureandsport,andspecialartsandcraftsthatneedtorecruitjuvenilesundertheageof16mustgothroughtheformalitiesofexaminationandapprovalaccordingtotherelevantprovisionsoftheStateandguaranteetheirrighttocompulsoryeducation.CHAPTERIII.EMPLOYMENTCONTRACTSANDCOLLECTIVEAGREEMENTSSection16.Alabourcontractistheagreementreachedbetweenalabourerandanemployingunitfortheestablishmentofthelabourrelationshipandthedefinitionoftherights,interestsandobligationsofeachparty.Alabourcontrac
