Issue781Standard3.1.1STANDARD3.1.1INTERPRETATIONANDAPPLICATION(Australiaonly)PurposeThisStandardsetsouttheinterpretationandapplicationprovisionsthatapplytotheotherfoodsafetystandardssetoutinthisChapteroftheCode.TheobjectiveofthefoodsafetystandardsistoensurethatonlysafeandsuitablefoodissoldinAustralia.Contents1Interpretation2Meaningofsafeandsuitablefood3GeneralapplicationoftheFoodSafetyStandards4CompliancewiththeFoodSafetyStandardsClauses1InterpretationInthisChapterthedefinitionsofthefollowingtermsapply–appropriateenforcementagencymeansanenforcementagencyprescribedbytheregulationsundertheActforthepurposesofenforcementoftheActorsimilarpurposes.authorisedofficermeansapersonauthorisedorappointedundertheActorotherlegislationforthepurposesofenforcementoftheAct,orsimilarpurposes,suchasan‘authorisedofficer’,‘environmentalhealthofficer’or‘inspector’.cleanmeanscleantotouchandfreeofextraneousvisiblematterandobjectionableodour.contaminantmeansanybiologicalorchemicalagent,foreignmatter,orothersubstancesthatmaycompromisefoodsafetyorsuitability.contaminationmeanstheintroductionoroccurrenceofacontaminantinfood.equipmentmeansamachine,instrument,apparatus,utensilorappliance,otherthanasingle-useitem,usedorintendedtobeusedinorinconnectionwithfoodhandlingandincludesanyequipmentusedorintendedtobeusedtocleanfoodpremisesorequipment.foodbusinessmeansabusiness,enterpriseoractivity(otherthanprimaryfoodproduction)thatinvolves–FederalRegisterofLegislativeInstrumentsF2009C00816Issue782Standard3.1.1(a)thehandlingoffoodintendedforsale;or(b)thesaleoffood;regardlessofwhetherthebusiness,enterpriseoractivityconcernedisofacommercial,charitableorcommunitynatureorwhetheritinvolvesthehandlingorsaleoffoodononeoccasiononly.foodhandlermeansapersonwhodirectlyengagesinthehandlingoffood,orwhohandlessurfaceslikelytocomeintocontactwithfood,forafoodbusiness.foodhandlingoperationmeansanyactivityinvolvingthehandlingoffood.foodpremisesmeansanypremisesincludingland,vehicles,partsofstructures,tents,stallsandothertemporarystructures,boats,pontoonsandanyotherplacedeclaredbytherelevantauthoritytobepremisesundertheFoodActkeptorusedforthehandlingoffoodforsale,regardlessofwhetherthosepremisesareownedbytheproprietor,includingpremisesusedprincipallyasaprivatedwelling,butdoesnotmeanfoodvendingmachinesorvehiclesusedonlytotransportfood.foodsafetystandardsmeansthestandardscontainedinChapter3oftheAustraliaNewZealandFoodStandardsCode.handlingoffoodincludesthemaking,manufacturing,producing,collecting,extracting,processing,storing,transporting,delivering,preparing,treating,preserving,packing,cooking,thawing,servingordisplayingoffood.hazardmeansabiological,chemicalorphysicalagentin,orconditionof,foodthathasthepotentialtocauseanadversehealtheffectinhumans.pestsincludebirds,rodents,insectsandarachnids.primaryfoodproductionmeansthegrowing,cultivation,picking,harvesting,collectionorcatchingoffood,andincludesthefollowing–(a)thetransportationordeliveryoffoodon,fromorbetweenthepremisesonwhichitwasgrown,cultivated,picked,harvested,collectedorcaught;(b)thepacking,treating(forexample,washing)orstoringoffoodonthepremisesonwhichitwasgrown,cultivated,picked,harvested,collectedorcaught;and(c)anyotherfoodproductionactivitythatisregulatedbyorunderanActprescribedbytheregulationsforthepurposesofthisdefinition.However,primaryfoodproductiondoesnotinclude–FederalRegisterofLegislativeInstrumentsF2009C00816Issue1113Standard3.1.1(d)anyprocessinvolvingthesubstantialtransformationoffood(forexample,manufacturingorcanning),regardlessofwhethertheprocessiscarriedoutonthepremisesinwhichthefoodwasgrown,cultivated,picked,harvested,collectedorcaught;or(e)thesaleorserviceoffooddirectlytothepublic;or(f)anyotherfoodproductionactivityprescribedbytheregulationsundertheActforthepurposesofthisdefinition.proprietorofafoodbusinessmeans–(a)thepersoncarryingonthefoodbusiness,or(b)ifthatpersoncannotbeidentified–thepersoninchargeofthefoodbusiness.sellmeans–(a)barter,offerorattempttosell;or(b)receiveforsale;or(c)haveinpossessionforsale;or(d)displayforsale;or(e)causeorpermittobesoldorofferedforsale;or(f)send,forwardordeliverforsale;or(g)disposeofbyanymethodforvaluableconsideration;or(h)disposeoftoanagentforsaleonconsignment;or(i)provideunderacontractofservice;or(j)supplyfoodasamealorpartofamealtoanemployee,inaccordancewithatermofanawardgoverningtheemploymentoftheemployeeoratermoftheemployee’scontractofservice,forconsumptionbytheemployeeattheemployee’splaceofwork;(k)disposeofbywayofraffle,lotteryorothergameofchance;or(l)offerasaprizeorreward;or(m)giveawayforthepurposeofadvertisementorinfurtheranceoftradeorbusiness;or(n)supplyfoodunderacontract(whetherornotthecontractismadewiththeconsumerofthefood),togetherwithaccommodation,serviceorentertainment,inconsiderationofaninclusivechargeforthefoodsuppliedandtheaccommodation,serviceorentertainment;or(o)supplyfood(whetherornotforconsideration)inthecourseofprovidingservicestopatientsorinmatesinpublicinstitutions,where‘publicinstitution’means‘publicinstitution’asdefinedintheAct,ifitissod
