Issue139Standard1.1A.61STANDARD1.1A.6TRANSITIONALSTANDARDFORSPECIALPURPOSESFOODS(INCLUDINGAMINOACIDMODIFIEDFOODS)(NewZealandonly)PurposeThisStandardincorporatestheprovisionsofRegulations237and239AoftheformerNewZealandFoodRegulations(1984),insofarastheyrelatetospecialpurposefoodsandaminoacidmodifiedfoods.ItisanticipatedthatthisStandardwillberepealeduponthedevelopmentofStandardsregulatingmedicalfoodsandfoodtypedietarysupplements.ThisStandardoperatessolelyinrelationtofoodsoldorimportedintoNewZealand.Clauses1Interpretation(1)InthisStandard–aminoacidmodifiedfoodmeansaspecialpurposefoodthatinthepreparationofwhichtherehasbeenarestrictionintheuseofingredientscontainingoneormoreparticularaminoacidsorareductionofthecontentofoneormoreparticularaminoacidsinanyoftheingredients.specialpurposefoodmeansafoodspeciallyprocessedorformulatedtosatisfyparticulardietaryrequirementsthatexistbecauseof–(a)aparticularphysicalorphysiologicalcondition;or(b)aspecificdiseaseordisorder;or(c)bothsuchaconditionandadiseaseordisorder;andarepresentedassuch.(2)OtherthaninDivision2inStandard2.9.3,areferenceinthisCodetoaspecialpurposefoodistakentobeareferencetoformulatedmealreplacement.Editorialnote:Theeffectofsubclause1(2)isthatadditivespermittedinformulatedmealreplacementsarepermittedinspecialpurposefoods.Subclause1(2)exemptsspecialpurposefoodsfromtherequirementsforminimumlevelsforprotein,kJ;andtheminimumandmaximumlevelsforvitaminsandminerals.Thedefinitionofformulatedmealreplacementsisnotintendedtobetakenliterallyinrelationtospecialpurposefoods.i.e.specialpurposefoodsarenotnecessarilyintendedasamealreplacement.2Application(1)Subjecttosubclause(2),forthemattersregulatedinthisStandard,foodproducedinorimportedintoNewZealandmustcomplywiththisStandard.(2)ThisStandarddoesnotapplytofoodproducedinorimportedintoAustralia.(3)ThisStandardceasestohaveeffectinrelationto:FederalRegisterofLegislativeInstrumentsF2013C00134Issue139Standard1.1A.62(a)foodforspecialmedicalpurposesonthedateofgazettalofFoodStandards(Proposal1023–Tutin,Tocopherols&FoodforSpecialMedicalPurposesStandardsAmendments)Variation;and(b)otherspecialpurposesfood,includingfoodformulatedandrepresentedasbeingforthedietarymanagementofobesityoroverweight,twoyearsfromthecommencementofanyalternativeapplicableprovisionselsewhereinthisCode.3CompositionSpecialpurposefoodsmaycontainanyofthevitaminsandmineralsspecifiedincolumn1ofTable1andcolumn1ofTable2inStandard2.9.3.4LabellingofspecialpurposefoodsEverylabelusedinconnectionwithaspecialpurposefoodmuststatethespecialpurposeofthefood.5Labellingofaminoacidmodifiedfoods(1)Thelabeloneachpackageofaminoacidmodifiedfoodshallbearoneormoreofthefollowing–(a)thewords‘aminoacidmodifiedfood’;(b)thenameoftheaminoacidoraminoacidsthathavebeenrestricted;(c)thenameofthedisease,oranamedescribingtheconditionofthegroupofpeople,forwhichtheproductisintended;(d)thewords‘lowprotein’,whereapplicable.(2)Thelabeloneachpackageofaminoacidmodifiedfoodshallbear,inthenutritioninformationpanel,astatementof–(a)thequantityofcarbohydrate,protein,andfatinthefood,expresseding;and(b)theenergycontentofthefood,expressedinkJ;and(c)thequantityofsodium,andofpotassium,inthefood,expressedinmg;and(d)thequantityoftheparticularaminoacidorproteinpresentinthefood,orboth,asappropriatefortheintendeduseofthefood.(3)Thelabeloneachpackageofaminoacidmodifiedfoodshallbear,intheprincipaldisplaypanel,in3mmlettering,thewords‘Takeonlyonmedicaladvice’.FederalRegisterofLegislativeInstrumentsF2013C00134
