76/769/EEC---IICOUNCILDIRECTIVEof27July1976ontheapproximationofthelaws,regulationsandadministrativeprovisionsoftheMemberStatesrelatingtorestrictionsonthemarketinganduseofcertaindangeroussubstancesandpreparations(76/769/EEC)THECOUNCILOFTHEEUROPEANCOMMU-NITIES,HavingregardtotheTreatyestablishingtheEuropeanEconomicCommunity,andinparticularArticle100thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanParliament(1),HavingregardtotheopinionoftheEconomicandSocialCommittee(2),Whereasanyrulesconcerningtheplacingonthemarketofdangeroussubstancesandpreparationsmustaimatpro-tectingthepublic,andparticularpersonsusingsuchsub-stancesandpreparations;Whereastheyshouldcontributetotheprotectionoftheenvironmentfromallsubstancesandpreparationswhichhavecharacteristicsofecotoxicityorwhichcouldpollutetheenvironment;Whereastheyshouldalsoaimtorestore,preserveandim-provethequalityofhumanlife;Whereasdangeroussubstancesandpreparationsaregov-ernedbyrulesintheMemberStates;whereastheserulesdifferastotheconditionsoftheirmarketinganduse;whereasthesedifferencesconstituteanobstacletotradeanddirectlyaffecttheestablishmentandfunctioningofthecommonmarket;Whereasthisobstacleshouldthereforeberemoved;where-asthisentailsapproximatingthelawsgoverningthematterintheMemberStates;Whereasprovisionsrelatingtocertaindangeroussub-stancesandpreparationshavealreadybeenlaiddowninCommunityDirectives;whereasitisstillnecessarytoes-tablishrulesforotherproducts,inparticularforthoseinrespectofwhichinternationalorganizationshavedecidedonrestrictionssuchaspolychlorinatedbiphenyls(PCB),adecisionrestrictingtheproductionanduseofwhichwasadoptedbytheCounciloftheOECDon13February1973;whereassuchameasureisnecessarytopreventtheabsorptionofPCBbythehumanbodyandtheresultantdangertohumanhealth;Whereasdetailedexaminationshaveshownthatpolychlori-natedterphenyls(PCT)entailriskssimilartothosepres-entedbyPCBs;whereasthemarketinganduseofsuchsubstancesshouldalsoberestricted;Whereasitwillbenecessary,moreover,periodicallytore-viewthewholeproblemwithaviewtomovinggraduallytowardsacompletebanonPCBsandPCTs;(1)OJNoC60,13.3.1975,p.49.(2)OJNoC16,23.1.1975,p.25.76/769/EEC---IIIWhereastheuseofchloro-1-ethylene(monomervinylchloride)asanaerosolpropellantinvolvesdangerstohumanhealthandtheusethereofshouldbeprohibited,HASADOPTEDTHISDIRECTIVE:76/769/EEC---I1Article11.WithoutprejudicetotheapplicationofotherrelevantCommunityprovisions,thisDirectiveisconcernedwithre-strictingthemarketinganduseintheMemberStatesoftheCommunity,ofthedangeroussubstancesandprepara-tionslistedintheAnnex.2.ThisDirectiveshallnotapplyto:(a)thecarriageofdangeroussubstancesandpreparationsbyrail,road,inlandwaterway,seaorair;(b)dangeroussubstancesandpreparationsexportedtonon-membercountries;(c)substancesandpreparationsintransitandsubjecttocustomsinspection,providedthattheyundergonoprocessing.3.ForthepurposesofthisDirective:(a)‘substances’meanschemicalelementsandtheircom-poundsastheyoccurinthenaturalstateoraspro-ducedbyindustry;(b)‘preparations’meansmixturesorsolutionscomposedoftwoormoresubstances.Article2MemberStatesshalltakeallneccessary(SIC!necessary)measurestoensurethatthedangeroussubstancesandpreparationslistedintheAnnexmayonlybeplacedonthemarketorusedsubjecttotheconditionsspecifiedtherein.SuchrestrictionsshallnotapplytomarketingoruseforResearchandDevelopmentoranalysispurposes.Article2aAmendmentsrequiredtoadapttheAnnexestotechnicalprogress,withregardtothesubstancesandpreparationsalreadycoveredbytheDirective,shallbeadoptedinac-cordancewiththeprocedurelaiddowninArticle21ofDirective67/548/EEC(3),aslastamendedbyDecision88/490/EEC(4).Article31.MemberStatesshallbringintoforcetheprovisionsnecessarytocomplywiththisDirectivewithin18monthsofitsnotificationandshallforthwithinformtheCommis-sionthereof.2.MemberStatesshallcommunicatetotheCommissionthetextoftheprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirective.(3)OJNo196,16.8.1967,p.1.(4)OJNoL259,19.9.1988,p.1.76/76989/67876/76976/769/EEC---I2Article4ThisDirectiveisaddressedtotheMemberStates.76/76976/769/EEC---I3ANNEXIDesignationofthesubstance,ofthegroupsofsubstancesoroftheprepara-tionConditionsofrestriction1.—Polychlorinatedbiphenyls(PCB)exceptmono-anddichlorinatedbiphenylsMaynotbeused.However,thefol-lowingcategoriesmaybeusedunderthefollowingconditions:85/467—Polychlorinatedterphenyls(PCTs)—Preparations,includingwasteoils,withaPCBor1.until30June1986atthelatest:closed-systemelectricalequip-menttransformers,resistorsandinductors;wasteoils,withaPCBorPCTcontenthigherthan0,005%byweight.2.until30June1986atthelatest:largecondensers(∫1kgtotalweight);89/6773.until30June1986atthelatest:smallcondensers(providedthatthePCBhasamaximumchlor-inecontentof43%anddoesnotcontainmorethan3,5%ofpenta-andhigherchlorinatedbiphenyls);4.until30June1986atthelatest:heat-transmittingfluidsinclosed-circuitheat-transferin-stallations:5.until30June1986atthelatest:hydraulicfluidsforundergroundminingequipment;—Theuseofequipment,plantandfluidsreferredtoinpoints1to5abovewhichareinse
