Issue1241Standard2.6.3STANDARD2.6.3KAVAPurposeThisStandardcontainsrestrictionsonthepartsofthePipermethysticum(kava)plantwhichmaybesoldunderfoodlegislation,andprovidesrequirementsforlabelling.TheStandardalsoprohibitstheuseofkavaasaningredientinfood.InAustralia,thisStandardshouldbeconsideredinconjunctionwiththeCustoms(ProhibitedImports)Regulations1956andcertainStateandTerritoryrestrictionsonthesupplyofkavawhichseektominimisethedetrimentaleffectsassociatedwithkavaabuse.Wherekavaispermittedforsupply,therequirementsinthisStandardcomplementthoserestrictions.TableofProvisions1Interpretation2Prohibition3Labelling1InterpretationInthisStandard–coldwaterextractionmeanstheaqueoussuspensionofkavausingcoldwateronlyandexcludestheuseofanyorganicsolvent.2Prohibition(1)Pipermethysticum(kava)oranyderivedsubstancemustnotbesoldunlessitis–(a)abeverageobtainedbycoldwaterextraction;or(b)thedriedorrawformofthepeeledrootorpeeledrootstockofplantsofthespeciesPipermethysticum.(2)Kavamustnotbeusedasaningredientinfoods.3Labelling(1)Thereshallbewritteninthelabelonorattachedtoapackagecontainingkava,thefollowingstatements–(a)‘Useinmoderation’;and(b)‘Maycausedrowsiness’.(2)Wherekavaisotherthaninapackage–(a)thenameandbusinessaddressinAustraliaorNewZealandofthesupplierofthefood;and(b)thestatementsundersubclause3(1);mustbedisplayedonorinconnectionwiththedisplayofthefood.FederalRegisterofLegislativeInstrumentsF2011C00587Issue1242Standard2.6.3{THISPAGEINTENTIONALLYLEFTBLANK}FederalRegisterofLegislativeInstrumentsF2011C00587
